DMV working on issue of driver’s licenses for illegal immigrants

The California Department of Motor Vehicles is getting closer to a decision on providing driver’s licenses to illegal immigrants who qualify for federal work permits under a new initiative of the Obama administration.

DMV spokesman Mike Marando said Monday the agency’s staff is working through technical issues including a determination of whether the Legislature will have to clarify the law.

‘It appears that young people who receive federal deferrals will be eligible for California driver’s licenses, but it remains uncertain whether clarifying legislation or regulations will be necessary,’’ Marando said in a statement. ‘This is because under current state regulations, only certain types of federal immigration documents support the issuance of a California driver’s license.’’

The federal program defers deportation for immigrants brought to the United States illegally when they were minors and provides them with work permits. It is estimated that up to 350,000 Californians may be eligible.

‘Further state legislative or regulatory clarification may be needed if the federal government’s new deferral program results in the issuance of new or different immigration documents,’’ Marando said.
