Arizona Gov. Jan Brewer abruptly suspends state's attorney general from illegal immigrant law defense

A sudden new twist in the ongoing rhetorical and legal struggle over Arizona's tough new law to round up illegal immigrants.

Late Friday night as the Memorial Day weekend began, Arizona's Republican Gov. Jan Brewer, in effect, suspended the state's Democratic attorney general from defending the new law in upcoming legal challenges. The measure, known as S.B. 1070, is due to take effect this summer and, among other things, allows local police under federal guidelines to check the immigration status of people they stop. The governor's abrupt action against Terry Goddard, her likely Democratic opponent in this fall's gubernatorial election, came after months of disputes between the two and at the end of a long day of legal maneuvering in both Arizona and the nation's capital.

As the state's chief lawyer, Goddard would be expected to take the lead in defending Arizona against....

...challenges to the Legislature's action, which erupted after years of state frustration with the federal government's inability to secure the state border with Mexico against illegal immigrants, drugs and criminals.

However, Goddard has vocally opposed the measure, so much so that the Legislature gave the governor advance authority to hire outside legal counsel.

On Friday, Goddard met with the Obama administration's Atty. Gen. Eric Holder in Washington, then held a news conference just hours before Brewer's handpicked attorneys were to meet with Holder, an outspoken critic of the law.

Brewer said, "I believe the federal government should use its legal resources to fight illegal immigration, not the State of Arizona."

Seeing apparent collusion between the two Democrat lawyers, Brewer pulled the plug Friday night.

Her statement (full text below) said:

Due to Attorney General Goddard’s curious coordination with the U.S. Department of Justice today and his consistent opposition to Arizona’s new immigration laws, I will direct my legal team to defend me and the State of Arizona rather than the Attorney General in the lawsuits challenging Arizona’s immigration laws.

Despite widespread criticism in the media and the Obama administration, whose officials including Holder admitted they had not actually read the legislation, numerous polls have shown deep support for the measure nationally and within Arizona.

And that approval has transferred over to Brewer, who was trailing Goddard early this year in polls of a hypothetical matchup come Nov. 2. Brewer inherited the governor's office last year when Janet Napolitano resigned to accept the man-caused nomination of Homeland Security secretary from President Obama.

Brewer has sought to meet with the now-vacationing Obama during a trip to Washington next week. But the Democrat has been unable to fit the Republican governor and the border issue into his impossible schedule.

Full text of Statement by Arizona Gov. Jan Brewer

Today the legal team I have appointed to defend the State of Arizona in the legal challenges to Arizona’s new immigration laws met with senior officials from the United States Department of Justice. The meeting was held at the request of the U.S. Department of Justice.  

The Department attorneys were advised that I believe the federal government should use its legal resources to fight illegal immigration, not the State of Arizona.

They were further advised that on behalf of the State of Arizona, I will ensure the immigration laws we passed are vigorously defended all the way to the United States Supreme Court if necessary.Arizona state Flag

For some inexplicable reason, the Department of Justice officials met with the Arizona Attorney General hours before meeting with the State of Arizona’s legal team, and then allowed the Attorney General to hold a press conference to discuss the meeting.  

This level of coordination between the Attorney General and the Obama Administration is disturbingly similar to the coordination with Democratic Congresswoman Gabrielle Giffords earlier this week on President Obama’s still unclear plan to deploy up to 1,200 National Guard troops to the border.  

Due to the Attorney General’s opposition to Arizona’s immigration laws as set forth in S.B. 1070, the Legislature required Attorney General Goddard to act at the direction of the Governor in any challenge to S.B. 1070 as amended by H.B. 2162.   The Legislature also gave the Governor authority to hire outside counsel if necessary to defend the law on behalf of the State instead of using the Attorney General. 

The Legislature gave me this authority because of its lack of confidence in the Attorney General’s willingness to vigorously defend this legislation that is so critical to protecting the safety and welfare of Arizona’s citizens.  Last year, I instructed the Attorney General to change his position on behalf of the State of Arizona in the Horne v. Flores case involving a challenge to the Arizona’s English language learner laws.  He refused and the U.S. Supreme Court ultimately rejected his position.

Due to Attorney General Goddard’s curious coordination with the U.S. Department of Justice today and his consistent opposition to Arizona’s new immigration laws, I will direct my legal team to defend me and the State of Arizona rather than the Attorney General in the lawsuits challenging Arizona’s immigration laws.    ####

That it is deemed as important to every state from the West to East coast? Attn: Be aware that illegal immigrants, who have violated the law, may try to vote for pro-amnesty incumbent lawmakers in primary and November elections?

This has everything to do with illegal immigration and nothing to do with unfair profiling. I love Hispanics and their culture, but I dislike any individual regardless of what country they're from if they come into this country illegally and think that they have earned the same rights as the rest of us that are here legally. That's it - plain and simple. It's nothing more complicated than that. I have a question for illegal immigrants - what would Mexico or another country do if American citizens started arriving in Mexico or another country illegally? They'd boot us out! I'd hate to see what would happen in Russia or perhaps a third world country in this situation. No one wants to break-up families, but legals are not responsible for the illegal choices and decisions that have been made. I've talked to many legal immigrants from other countries (including other hispanic nations) and they are upset to think that they had to follow a long, legal process to gain their citizenship and don't understand why illegals may get a get-out-of-jail free card. This is only about enforcing the law that has been in existence for years. No one blames anyone for wanting a better life - just do it legally. My advice to illegals: start the legal process because then no one has a reason to complain.

@geroguy 3:38am - Of all the defenses of undocumented immigrant labor, your perceived entitlement to cheap produce is perhaps the most specious. There is a real human cost to that cheap lettuce you enjoy no matter what comforting fables you tell yourself about how "those people" really don't mind working 12 hours a day in the hot sun for sub-minimum wage under abusive conditions. That $12.90 a head you claim we'd be paying if we could no longer exploit the quasi-slavery of migrant farm work represents the externalization of that human cost.

First, only around 20% of illegals work in agriculture -- most do work that very recently was done by working class Americans who received good wages. Take a look at construction sites in California -- they used to be mostly 'Anglo'. Not coincidentally, wages in construct have declined.

Second, even in agriculture, only around 10% of the costs of produce is labor. For every $1 you spend, we could triple wages and you'd only be spending $1.20.

But even that would probably not happen. Farmers would either mechanize or, as some agribusinesses have done, rent land in Mexico to produce crops. Thtat is the way trade is supposed to work -- the lower paying jobs get done in low wage countries. Mexicans can stay home and work at decent wages (for Mexico), US taxpayers don't have to pay the extra costs associated with an immigrant work force.

How is it racist and "hate filled" to talk about illegal aliens? You're trying to fuse the issue in order to smack down any reasonable argument that talks about enforcing current laws/deportation. While there are some who are racists, I believe, as myself, the vast majority of people just want these persons deported and or prosecuted for thumbing their nose at our country's laws.

The Mexican President had no right to be in our Congress lecturing on our law. His own country is riddled with corruption, drugs, inhuman treatment of his citizens, shoot-outs in streets, killings, rapes, theft and crime. A country whose own illegal alien law in itself a tougher law than ours. It's an outrage that our Gov't allowed this man to speak in our House.

If Koreans or Chinese or Irish or Canadians migrate to America legally are they thrown out? There's no halt in the legal process to become a citizen of the United States. There is nothing new on the books. Follow the law. Immigrants are welcome, but they must follow the law.

If you are going to use God to defend illegal immigration - please read the following Scripture in context:

1 Peter, Chapter 2, verses 13-15:

For it is the will of God that by doing good you may silence the ignorance of foolish people.

"Be subject to" means to obey and follow the established rules. As a Christian, we are admonished to follow the laws of the government which rules us; because they are instituted by God. So if the illegal aliens cannot obey our laws, then they (from a biblical standpoint) must suffer the punishments instituted by the government (which government is instituted and exists by God's will).

What is an evil doer? A person who does not follow the law - whether it is God's law or man's.

What are people who do not follow the prescribed laws of the US (a government instituted by God as stated by St. Peter): the US government calls them illegal aliens/immigrants; and since they don't follow the rules, from a Biblical standpoint they are evildoers.

It is GOD's will we should ALL do things the right way - not deceitfully, not by evil means - but the right way, and the right way to become a US citizen is through established government rules - anything less is against the law, or from an evil basis, and therefore against God's will.

Jan Brewer for President. For once a leader who is actually doing something constructive, putting the states equal with the federal government, and has the clever moxy to get it all done. Crazy like a fox-- Jan Brewer for first woman Prez!

This law is not draconian, or racist. The State of Arazonia has simply said that sinse the federal government refuses to enforce the law as written they will. People who speak against the law are people who do not know the problem.

What's the big deal???
You prove to law enforcement you're a citizen.
You prove to law enforcement you're in the U.S. legally.
The State of Arizona isolates and identifies those who are neither.
The illegals are dealt with.

I find it hard to believe that the majority of Hispanic-Americans, citizens and legal immigrants, will support the rights of other Hispanics to come here illegally. This makes no sense.

I applaud the Arizona governor and plan to order all my internet based purchases from Arizona based companies to show my support. The Attorney General should be removed from office and exposed as the Obama/Holder lackey that he is. She should also expect the greatest amount of support from other true Americans who support her and the Arizona anti-illegal immigration bill. God bless her and those around her, especially those wearing the uniform of the United States military and all police organizations who put their lives on the line every day and night to keep us safe and free.

This is the dumbest argument ever... well maybe not, but it is way up there. Entering ANY country without the proper documentation is ILLEGAL (aka against the law). Get serious and hold the employers accountable for hiring ILLEGALs of every nationality (for example Bush had an illegal maid, he should have been accountable for that), don't give out aid to folks without paperwork, and deport those without the proper documentation. People who say this law is bigoted are either uninformed or here illegally. How can you be serious? Are you aware that we are a sovereign nation? Are you aware that we have a RIGHT to enforce our borders? Particularly in the age of terrorism? Are you aware this AZ law is an exact copy of the Federal law, and you are in fact by proxy calling the United States Federal laws bigoted? My family immigrated to this country LEGALLY way back in 1676, back when we were all regents of England. My family fought in the American Revolution, for the Ohio Mounted Cavalry in the Civil War, my Grandfather in Korea, my Father in Vietnam. My family has defended this country for generations, and I will be DAMNED if someone tries to sneak into my country in the dead of night and call my country's sovereign right to enforce our borders "bigoted". Tell that to Iran or North Korea where you can be executed for sneaking into their country. We desperately want and need hard working, English- speaking immigrants in our country, but what we don't need is millions sneaking in, thumbing their nose at our laws, and refusing to ingratiate and calling us "bigots" because we want some form of order in our immigration process. Oh, brother. People who are against the SB1070 law mostly have not read it, and those who have either deliberately misunderstand it, or just choose to continue to outright lie about it.

Nobody has to carry "papers" or their birth certificate with them. First, nobody can be pulled over simply because an officer thinks they might be here illegally. It has to be in conjunction with another legal contact such as a traffic violation or other crime. Driver's licenses are only issued to citizens, so if an illegal immigrant is pulled over and doesn't have a driver's license, then it is a pretty safe assumption they are not here legally. If you are pulled over and show a valid driver's license, then you won't have any problem unless it is obviously a fake. Comparing AZ to Nazis is false and repugnant. We are asked many times a week to show our ID to cash a check, use a credit card, etc. All of a sudden the same ID at a traffic stop is a violation of civil rights? Give me a break!

Get your facts straight rather than trying to sow fear and discord simply to support your unfathomable feeling that it is OK to blatantly violate a countries laws when EVERY country in the world, including Mexico, has immigration laws that they enforce. Most other countries laws are much tougher than ours.

Also, stop lumping legal and illegal immigration together and try to make it so if you are against illegal immigration, you're also against legal immigration and therefore a bigot who hates anyone who isn't white. I'm white and I could care less what color you are if you're here illegally, and I don't care what color you are if you're here legally.

And, for those arguing that if illegals are stopped, our prices are going to skyrocket, congratulations. You're using the exact same argument the Southern states used to try and keep slavery legal. You should be proud of yourself.

Passing out green cards so immigrants can continue to work for low wages under the table while they collect welfare, food stamps, housing, etc? Comprehensive immigration reform means one thing: AMNESTY! The left doesn't care how much groceries costs. What they care about is getting reelected and with their lousy records, the ONLY way reelection would occur is by granting hispanics and latinos amnesty, thus making them voting citizens! Do you honestly think these "new" citizens will continue to work under the table for less than minimum wage? Do you honestly think these "new" citizens won't join the unions? What idiots you people are! All this country needs to do is ENFORCE EXISTING LAWS! By doing this, illegals are forced to leave and THEN, migrant worker permits would issue to Mexicans to come across the border during harvesting to work those so-called jobs American citizens won't do (although I disagree with that thinking during this depression). Bottom line, migrant workers can LEGALLY do the work and return home when the work's done. Prices do not go up. Prisons will clean out. Billons of dollars will be saved from social services/entitlement distributions. Billions more saved in education while bringing quality of education back up to standards sans ESL and 'special needs' (i.e., dummying down). This is a country of laws that are already on the books to protect the American citizen. All we have to do is see to it that these laws are ENFORCED. What this country does not want or need or can afford is amnesty of up to 30 million illegals. The money saved from supporting illegals could be used to support American citizens who are poor, disadvantaged, homeless, etc. Country first! America is a country of immigrants. Agressive ones at that, who stole the land they want now to keep free of other immigrants choosing to call them illegal, who do not come to steal as they did, but to earn an honest living. Mexicans as well as other immigrants have shed their life's blood and are the most productive, honest people the USA has ever had. America gave a people legal status because they chose to have a dictator for 51 years(you cannot expect stones thrown from Florida to hit Castro) and let them become the best at taking millions of American dollars in their many schemes, to the degree that our health programs are failing under the strain of no federal money left. Being in the USA from the time settlers took over Indian land, Mexico should have open LEGAL passage to America. In fact Mexico should become the largest state of the USA. Yes, that would be the only decent solution to this Arizona madness which is as close to the kkk mentality as I can imagine. Millions of immigrants populate all the USA and some reasonable and humane solution should be found by a nation that claims to be 'One Nation UNDER God". She should be ashamed as should the mad bigots who put this insane law before her to sign. But in America the majority ARE God loving, God fearing people and as all other bad things America has been ashamed about, 'this too shall pass'. God Bless the USA and ALL its decent people,no matter what color, race or country of origin.. And PLEASE stand up for what is right.

this is absolutely ridiculous. it is unfair to the citizens of Arizona. also it is a form of racism because who do you think is going to be stopped by the police, the white people? no. its going to hurt the immigrants who have come here both legally and illegally. should the government do something about illegal immigration? sure, but this is beyond wrong.

DEAR GOV. BREWER, I JUST GOT FINISHED LISTENING TO JANET NAPOLITANO TAKING ALL THE CREDIT FOR THE THINGS YOU HAVE DONE, FROM BEING THE FIRST TO EVEN TALK ABOUT SECURING OUR BORDERS, AND GETTING ILLEGAL IMMIGRINTS OUT OF OUR STATE. I FOR ONE, REMEMBER HOW MANY TIMES SHE STOOD THERE AND SAID THAT OUT BORDERS ARE AS SECURE AS THEY HAVE EVER BEEN. HOW STUPID CAN SHE BE? SHE WAS USELESS WHEN SHE WAS HERE, AND GOD KNOWS SHE'S DOUBLY USELESS NOW. THAT WHOLE ADMINISTRATION HAS LIED SO MUCH ABOUT EVERYTHING, THEY WOULD NOT KNOW THE TRUTH IF IT SLAPPED THEM IN THE FACE. YOU ARE THE ONE RESPONSIBLE FOR GETTING ALL THE OTHER STATES ON BOARD, AND IF IT HAD NOT BEEN FOR YOU, NONE OF THIS "SHOWBOATING" WOULD EVER HAVE HAPPENED, BUT AT LEAST, BECAUSE OF YOU, WE WILL HAVE A MORE SECURE BORDER. I FOR ONE THANK YOU FOR ALL YOU HAVE DONE, AND I WILL TELL YOU I HAVE ALREADY SEND IN MY EARLY BALLOT, AND YOU AND JOHN MC CAIN ARE DEFINITELY AT THE TOP OF MY LIST. THANKS AGAIN, JANICE PRESCOTT
