Arizona Gov. Jan Brewer abruptly suspends state's attorney general from illegal immigrant law defense

A sudden new twist in the ongoing rhetorical and legal struggle over Arizona's tough new law to round up illegal immigrants.

Late Friday night as the Memorial Day weekend began, Arizona's Republican Gov. Jan Brewer, in effect, suspended the state's Democratic attorney general from defending the new law in upcoming legal challenges. The measure, known as S.B. 1070, is due to take effect this summer and, among other things, allows local police under federal guidelines to check the immigration status of people they stop. The governor's abrupt action against Terry Goddard, her likely Democratic opponent in this fall's gubernatorial election, came after months of disputes between the two and at the end of a long day of legal maneuvering in both Arizona and the nation's capital.

As the state's chief lawyer, Goddard would be expected to take the lead in defending Arizona against....

...challenges to the Legislature's action, which erupted after years of state frustration with the federal government's inability to secure the state border with Mexico against illegal immigrants, drugs and criminals.

However, Goddard has vocally opposed the measure, so much so that the Legislature gave the governor advance authority to hire outside legal counsel.

On Friday, Goddard met with the Obama administration's Atty. Gen. Eric Holder in Washington, then held a news conference just hours before Brewer's handpicked attorneys were to meet with Holder, an outspoken critic of the law.

Brewer said, "I believe the federal government should use its legal resources to fight illegal immigration, not the State of Arizona."

Seeing apparent collusion between the two Democrat lawyers, Brewer pulled the plug Friday night.

Her statement (full text below) said:

Due to Attorney General Goddard’s curious coordination with the U.S. Department of Justice today and his consistent opposition to Arizona’s new immigration laws, I will direct my legal team to defend me and the State of Arizona rather than the Attorney General in the lawsuits challenging Arizona’s immigration laws.

Despite widespread criticism in the media and the Obama administration, whose officials including Holder admitted they had not actually read the legislation, numerous polls have shown deep support for the measure nationally and within Arizona.

And that approval has transferred over to Brewer, who was trailing Goddard early this year in polls of a hypothetical matchup come Nov. 2. Brewer inherited the governor's office last year when Janet Napolitano resigned to accept the man-caused nomination of Homeland Security secretary from President Obama.

Brewer has sought to meet with the now-vacationing Obama during a trip to Washington next week. But the Democrat has been unable to fit the Republican governor and the border issue into his impossible schedule.

Full text of Statement by Arizona Gov. Jan Brewer

Today the legal team I have appointed to defend the State of Arizona in the legal challenges to Arizona’s new immigration laws met with senior officials from the United States Department of Justice. The meeting was held at the request of the U.S. Department of Justice.  

The Department attorneys were advised that I believe the federal government should use its legal resources to fight illegal immigration, not the State of Arizona.

They were further advised that on behalf of the State of Arizona, I will ensure the immigration laws we passed are vigorously defended all the way to the United States Supreme Court if necessary.Arizona state Flag

For some inexplicable reason, the Department of Justice officials met with the Arizona Attorney General hours before meeting with the State of Arizona’s legal team, and then allowed the Attorney General to hold a press conference to discuss the meeting.  

This level of coordination between the Attorney General and the Obama Administration is disturbingly similar to the coordination with Democratic Congresswoman Gabrielle Giffords earlier this week on President Obama’s still unclear plan to deploy up to 1,200 National Guard troops to the border.  

Due to the Attorney General’s opposition to Arizona’s immigration laws as set forth in S.B. 1070, the Legislature required Attorney General Goddard to act at the direction of the Governor in any challenge to S.B. 1070 as amended by H.B. 2162.   The Legislature also gave the Governor authority to hire outside counsel if necessary to defend the law on behalf of the State instead of using the Attorney General. 

The Legislature gave me this authority because of its lack of confidence in the Attorney General’s willingness to vigorously defend this legislation that is so critical to protecting the safety and welfare of Arizona’s citizens.  Last year, I instructed the Attorney General to change his position on behalf of the State of Arizona in the Horne v. Flores case involving a challenge to the Arizona’s English language learner laws.  He refused and the U.S. Supreme Court ultimately rejected his position.

Due to Attorney General Goddard’s curious coordination with the U.S. Department of Justice today and his consistent opposition to Arizona’s new immigration laws, I will direct my legal team to defend me and the State of Arizona rather than the Attorney General in the lawsuits challenging Arizona’s immigration laws.    ####

Looks as if the editor(s) at the LA LA Land Times didn't quite do a good enough job in writing over their last White House-Approved article.

Good for you Governor Brewer. All those nath sayers, should come to Az. and go the border for a few days, especially where the police officer was hurt or where the cattle man was killed and see for themselves what people here in Arizona have to put up. Fires started by these illegals, trash, killing, damage to people properties, illegals getting sick because of heat stroke and then having them rushed to hospitals for care and it goes on and on. Our state would probably not be in the broke, if we did not have to spend our dollars for these illegals, like education, housing, food stamps, medical help, jailing, even the expenses to transport them to ICE and what there expenses are to house them before deportation,etc.

This is such a bogus argument on the part of some. Business boycotts; we should be assisting Arizona instead of punishing them.

The law not only involves Latinos who cross illegally but is intended to snatch the thousands of Middle Easterners who are penetrating our southern border.

I suggest readers see the following clips showing what an Atlanta TV station found in Arizona.

Prayer rugs, Samalian military uniforms with Jihad patches on the sleeve, to mention a few. Doesn't Holder et al read the congressional reports about how many illegals from Sudan, Afghanistan, Egypt, Pakistan, Yemen and Iran have been captured. Care to guess how many have not been captured? It's frightening when you read that South American Countries have been teaching these illegals Spanish so they can blend in when the cross the border.

Thank goodness that Gov. Brewer is protecting the legal citizens of her state as well as the states these dangerous people are traveling to.

I'm sure the majority of Germans in the 1930's approved of Hitler's plan to first make Jews carry papers and then round them up and put them into concentration camps. It doesn't make it right. Few white people have the intellectual ability to understand what it would be like to be a minority and pulled over by the police for "driving while black/brown"; no white people have the emotional ability.

The architect of SB 1070 and HB 2281 is state senator Russell Pearce who has been associated with hate crime groups such as the neo-nazi's and other radical right reactionary efforts. He literally wraps himself in the American flag portraying himself as a great patriot. This is the guy that Governor Brewer has put in charge of her state. Now she is paying a price for it as national leaders and organization want nothing to do with Arizona. As a resident of Arizona, and a white male to boot, I am embarrassed by the racist, ethnic cleansing behavior of our so called leaders.

Brewer is one of the few Republicans who have a spine. Getting rid of a weak read/fifth-columnist like Goddard is a smart move. It's LONG past time we clean house of these enabler of illegals.

It's disheartening that White Europeans, who never suffered oppression, discrimination or racism by laws of this land, turn around and then create laws to single out an entire non-White ethnic group that will seek to humiliate and oppress them. Jan Brewer inherited the office and trailing BADLY in the polls and fearing the Hispanic vote, signed the bill. Pearce and coauthor Krobach are affiliated with f.a.i.r. with links to stormfront and other aryan wingnuttery groups. The bill was ill-written and had to be immediately amended and resubmitted. It still allows vague guidelines that has DOJ putting the bill under scrutiny. It hasn't been publicized but DOJ has had Arizona under investigation for racial profiling for several years. Arizona is now home to many midwestern and northwestern retirees that support this bill; they use services and don't pay taxes. The new population group doesn't see the irony in their stand on this faulty legislation.

I'm a Legal immigrant and very frustated that there are oposition to this Arizona Law. Illegals are illegal. Which is not a new law it just gives power to the state to do the job that the Feds won't do.
I carry my GREENCARD all the time, everywhere I go with my I.D. I would not be offended in any way if I go to Arizona and a cop ask me for my papers.
I am praying for G-d to bless Arizona and give strengten to its Governor.

You have to ask yourself why our Govt. and DOJ is coming down on the side of illegals, against both our Federal laws in place ( which they consistently refuse to enforce )and against AZ, who's only sin was to try to enforce the Federal laws already in place and give the police the tools to do that.
I guess the lure of possible votes in the 2010 elections is more powerful than protecting our citizens in border states.
I am ashamed of this administration and the positions they place as their priorities.

Why does the media like to go about officials in the Obama administration not reading the law before they signed it but not about Jan Brewer (as AZ Republic columnist Montini pointed out) signing it without ever acknowleging that she read the law before signing it?

I do live in Arizona and I have read the law. Here are my problems with it: 1. section 1, paragraph B requires the police investigate anyone who they have 'reasonable suspicion' may be in the country illegally following ANY police contact (this includes people who are themselves the victims, not the perpetrators of a crime, as well as people who could be questioned if the police claim they have committed a 'crime' like loitering or jaywalking,) and 2. section 1 paragraph G which allows any citizen of the state to sue the police if they do not believe they are enforcing the law. Combinign these two paragraphs means that you or I could sue the police if they don't question the immigration status of someone who (we claim) is guilty of loitering.

Sorry about that Arizona.•(a) Every law enforcement agency shall fully cooperate with the United States Immigration and Naturalization Service regarding any person who is arrested if he or she is suspected of being present in the United States in violation of federal immigration laws.
•(b) With respect to any such person who is arrested, and suspected of being present in the United States in violation of federal immigration laws, every law enforcement agency shall do the following: (1) Attempt to verify the legal status of such person as a citizen of the United States, an alien lawfully admitted as a permanent resident, an alien lawfully admitted for a temporary period of time or as an alien who is present in the United States in violation of immigration laws. The verification process may include, but shall not be limited to, questioning the person regarding his or her date and place of birth, and entry into the United States, and demanding documentation to indicate his or her legal status. (2) Notify the person of his or her apparent status as an alien who is present in the United States in violation of federal immigration laws and inform him or her that, apart from any criminal justice proceedings, he or she must either obtain legal status or leave the United States. (3) Notify the Attorney General of California and the United States Immigration and Naturalization Service of the apparent illegal status and provide any additional information that may be requested by any other public entity.
•(c) Any legislative, administrative, or other action by a city, county, or other legally authorized local governmental entity with jurisdictional boundaries, or by a law enforcement agency, to prevent or limit the cooperation required by subdivision (a) is expressly prohibited.

1 Question; When you go and visit someone or anyone you care for and respect. Do you enter through the front door which is being held open for you, or do you climb through the window or better still sneak around to the back door, so they won't welcome your visit.

The Governor has more support than just Arizona, she has stood firm against the bullys. I am appaled she is not receiving more support from DC for upholding the Federal law. Busing illegals in to protest the Arizona law today was a novel idea. Here is another one. Bus them out. Take all the illegals from jail, prison, detention, emergency rooms, under bridges, back streets and alleys, crack houses, shelters, low income housing, libraries, nursing homes, McDonalds and other fast food restaurants, soup kitchens, plasma centers, crammed motel rooms, Bureau of Land Management forest, city parks and bus them to sanctuary cities that are sending protesters to Phoenix. Top of the list would be San Francisco, L.A., San Diego, Chicago, Washington D.C., Austin, and Salt Lake City. Charter Arizona buses to shore up local businesses. It is after all a two way street. Parity better than charity.

No matter how many times liberals are given the facts of any issue, they never change their minds. They have their talking points and they will stick to them. CA would do well to elect a governor like Jan Brewer. Federal statute 8 USC 1373 requires the feds to verify a person's immigration status any time a state or local official asks for it. The federal government cannot deny assistance to Arizona without breaking the law itself.

2008 – AZ successfully defended its employer-sanctions law both in federal district court and
the 9th Circuit Court of Appeals
2006 - AZ successfully defended its human smuggling law.
2005 – AZ successfully defended its Prop. 200 requiring proof of citizenship for voting and restricting benefits to illegal aliens.

I spent 4 years in Arizona before finally leaving in disgust after rampant crime by illegals pretty much ruined my life (stole my identity and oh so much more). The police were so restricted they could not do a single thing about any of it- not even take reports.

It is so awesome to see someone finally standing up for citizens instead of criminals. I actually cried when I first heard about this.

Jan Brewer you are my hero.

AZ Gov.Brewer and the AZ State Legislature have plugged a hole in America's National Sovereignty, which I believe is DESIRED by the the Obama administration.

Obama is a One-Worlder, as he has openly indicated, i.e. telling us we are "citizens of the world"... screw that!

Americans have been harmed and died on American soil, during Obama's Watch, with deference to foreign trespassers! This attitude, presented by those SWORN TO DEFEND, not destroy the USA, should be considered treasonous!

[Hypothetical]: If a Secret Service Agent willingly stepped aside, during an attack, or even a rumor of an attack upon POTUS Obama, WHAT DISCIPLINE WOULD BE METED OUT AGAINST THE AGENT?

Are we to understand that POTUS is MORE equal than any other American? That flies in the 'face' of the Declaration of Independence... Oh yeah, a document drawn up by people with fundamentally flawed thinking[!]

So an elected official in the United States gets suspended because he is "coordinating with the United States government"? Does the AZ governer vonsider her state to be independent or autonomous from the rest of the country?

Federal government is responsible for enforcing federal laws, and states should help the federal government do that, not replace them. If the states do not like being a part of the federal government, perhaps they should become independent nations.

Thank God for Jan! What she is doing is exercising the will of the majority, especially actual "citizens". No state can afford millions of welfare cases, california is a prime example with billions of dollars in debt. This problem is costing every citizen of the U.S.! CA is not capable of bailing themselves out, at least Jan has the fortitude to defend the people of her state.

GREED of money & power is all that runs DC, that's why these illegal aliens have a purpose beyond the "cheap labor" latitude. Wake Up!

Federal law already requires that all non-american citizens,be they visitors or temporary or permanent residents carry documentation on them at all times, just as you are required by law to carry your license and proof of insurance when you operate a motor vehicle. So, as an immigrant myself (no matter that I came from eastern european/canadian stock) I must provide documentation when requested. If you critics would bother to read the law, that would be a start to an informed discussion. If you have not entered legally, you do not have a "right" to be anywhere.
How about putting pressure on Mexico to clean up their own mess to create opportunity for its citizens instead of exporting them here?? Novel concept, eh?
