Supreme Court today deliberates suit blocking Obama presidency

(UPDATE: The Supreme Court had issued no statement on its discussions by the close of business Friday.)

It may come as something of a shock to those millions planning trips to Washington for the Jan. 20 inauguration of President-elect Barack Obama that he isn't really legally capable of taking the oath.

It's the birth certificate thing. And we have a tendentious video below to show the kind of claims being made that he is not a "native-born" American.

That's because he was born in Kenya to an alien father and isn't a natural-born American as the Constitution requires and the copy of his Hawaii birth certificate looks fake to many and the state won't release the original, which makes everything that much more suspicious.

This controversy has been brewing for many months online with few taking it seriously. The Ticket wrote about it last June and again in August.

We published a birth certificate provided by the Obama presidential campaign, which has caused hundreds of commenters to argue back and forth over its authenticity, especially in recent weeks.

And we'll publish it again right here.

Crackpot controversy, you say. He's been accepted as a U.S. citizen.

But here's the thing: The United States Supreme Court officially takes up the issue of whether to ponder whether Obama can become president in formal discussions today in Washington.

What? Yup! A similar case was thrown out earlier this fall, but Justice Clarence Thomas distributed the legal papers in Donofrio vs. Wells to his court colleagues for legal conference today.

Hardly anyone thinks the case has a serious chance of ...

... succeeding, given the court's distaste for hanging chads and public disfavor for its involvement in settling the Al Gore-George W. Bush presidential contest over Florida in 2000.

Similar conspiracy efforts were mounted over John McCain having been born in a U.S. naval hospital in the Panama Canal Zone, where his father was stationed. They too might well have proceeded had the Arizonan won on Nov. 4.

But just think what would happen if the court did consider blocking Obama's inauguration, with the world already having congratulated him and Obama's Cabinet half-formed, not to mention him already having resigned from the Senate. Oops.

You'll note that Sens. Joe Biden and Hillary Clinton have not yet taken that irreversible step. Just saying.

The suit originally sought to stay the election, and was filed on behalf of Leo Donofrio against New Jersey Secretary of State Nina Mitchell Wells.

Legal records show it is only the tip of an iceberg of nationwide efforts seeking to derail Obama's election over accusations that he either wasn't born a U.S. citizen or that he later renounced his citizenship in Indonesia.

In one of those delicious ironies that makes life so interesting, the justice who distributed the case to his colleagues was none other than Thomas, only the second African American to sit on the high court. One presumes the justices saw some legal issue to mull.

A recent Tribune story wrote: "The most famous case questioning Obama's citizenship was filed in Pennsylvania in August on behalf of Philip J. Berg and sought to enjoin the Democratic National Committee from nominating Obama.

"The U.S. Supreme Court declined to accept the case. Earlier, a federal judge rejected it for "lack of standing" -- ruling that Berg had no legal right to sue. In cases like this, judges sometimes believe the matter is best left to political institutions, such as the Electoral College or Congress, according to legal scholar Eugene Volokh of the University of California at Los Angeles."

The remaining case with the highest profile is Donofrio vs. Wells. Because it was distributed by Justice Thomas to other justices, it gained undue importance for people unschooled in how the court works, Volokh said.

But it was. Now come the court's discussions. And presumably some decision on deciding.

THe "birth certificate" the times and the rest of the pro Obama media produce all the time is not a birth certificate at all. It is an abstract. Obama has not produced a real long form birth certificate. This is the rub. Why? I am well into my 40's and I found an abstract I requested in my 20's and my long form birth certificate in about 20 minutes.

This is all you need to know:

There are two documents.

The document displayed her is a "certificate of live birth" which is basically a printout on state stationary. It is not the birth certificate signed by the doctor (with the little foot prints).

There are two documents. The one everyone wants to see and the one displayed here which in a defensive move (chess) was sent to Annenburg's FactCheck.org, a website set up to defend Democrats from "swift boat" attacks.

So the Obama camp has chosen to let this matter go to the Supreme court (which installed Georg Bush) rather than just release his birth certificate. Again, the one displayed here is a computer printout of the information in the database on official state paper and is probably a month old.

Get it now? Two documents, the real one and the computer print out. Try to see through all of the lawyer generated noise. Its really simple. Obama shows birth certificate (with the foot prints) and all of this goes away.

To the Wise One and Paul: Hawaii accepts registration of births in other states and foreign countries. If you read the official press release by the officials of Hawaii all they assert is they have seen Obama's original birth certificate and they have it on file. They did not state where he was born or assert that he was native born. The press and Obama's operatives misstated what the state of Hawaii said to make it sound as if the state confirmed he was born in Hawaii. The state did not and has not confirmed where he was born.

To Hawkeyeted: Berg put the DNC on notice before the convention of his concerns that Obama was not a natural born American. Berg is a life long democrat and former chairman of the Montgomery Co democratic party. The DNC ignored him. Berg then file suit. Instead of disclosing Obama's original birth certificate, DNC and Obama attorneys fought Berg in federal court arguing he did not have standing to sue Obama for not being a natural born citizen. Odd behavior for someone who claims he is a natural born citizen. Why fight on procedural issues? Why fight at all? It would have been easier to show his original birth certificate, if he was born in Hawaii.

To others: Fact Check.org and Snopes proved nothing other than a total lack of objectivity.

I personally hope Obama was born in Hawaii, but I also hope the Supreme Curt takes up Berg's case so the facts can be determined. If he's not a natural born citizen, the leaders of the DNC and Obama should be held accountable for the massive fraud the have perpetrated upon the American people. What an insult to the memory of those who have given their lives in defense of the constitution a fraud of this nature would be. If he is natural born, it will be easy enough for Obama to prove. All he has to do is produce his original birth certificate showing he is a natural citizen. Leo Denofrio, who's case is now in front of SCOTUS has challenged the legality of three candidates that appeared on the New Jersey ballot for U.S. president: Democrat Barack Obama, Republican John McCain and Socialist Workers Party candidate Roger Calero.

The certificate shown was computer generated and refers to race as "African American". At the time of his birth that term was NOT used. It would have stated "Black". Too many discrepencies to just accept. I would love to hear Obama deposed under oath. Now that would be a real circus.

To Tom: I agree with you. the best thing the Court could do is hear the case so doubt as to his eligibility to be president can be eliminated, if he is eligible. Berg raises some good arguments that were put forth to the court in the Gore Bush fiasco to give him standing. Regardless, Alan Keyes certainly has standing. His case is currently wending its way through the court system to, I am sure, the Supreme Court. He points to the same evidence that Berg puts forth in his suit. If the Court doesn't hear Berg's case based solely on standing, they will hear it later based on standing.

The Supreme Court isn't required to accept any case for hearing. But I can't imagine any case that has clearer constitutional issues of as great a national importance than this one.

I pray the Court grants writ of certiorari in Berg v. Obama to maintain the integrity of our constitution. We must never allow our constitution to be trivialized.

To the author above who asked the question regarding on parent being a US citizen.

In this case at the time of his birth she would have been 18 years old. The law at the time stated she needed to be 14 years old plus 5 years to be considered a citizen. She did not meet the qualification that is why this whole case is taking place.

Also when he was in Indonisia his papers stated he was a citizen of that country in order to go to school. There have been no follow up documents supporting the fact that he changed his citizenship to a US citizen.

He traveled abroad on a passport to a country that the US was allowing no US citizens to travel to.

The man reeks of dishonesty.

He could have laid this whole thing to rest in one swift move of producing the original live birth record.

Claims that the US Constitution does not recognize a person born with dual citizenship as a "natural born citizen" are unfounded. The US Constitution does not say anything whatsoever on this issue.

It does state “No Person except a natural born Citizen, or a Citizen of the United States, at the time of the Adoption of this Constitution, shall be eligible to the Office of President”.

The reason for the distinction between natural born citizens and those who were citizens of the US at the time of the adoption of the constitution was NOT because the framers had dual citizenship at the time of their birth. They were British citizens/subjects at the time of their birth. The US did not exist at the time of their birth, thus neither did US soil, and thus no one born in America prior to the formation of the United States could be considered a natural born US citizen.

There are two documents. I think that's what is causing so much confusion.

The document Obama provided is displayed above. It is the "certification of live birth". It is a print out of data on state stationery. It is "printed" out. It is simply the data stored in the state database printed out on official state stationery. The document Philip Berg and others are fighting to see is the "certificate of live birth" which is the document filled out and signed by the doctor when Obama was born. The Obama camp is fighting release of the later tooth and nail.

I had a few hours recently of free time to review comments in the news and by readers.

Why does no one have anything good to say about Obama's side?? Most write "go back under the rock you came from" or the like, not too intelligent, but I assume this is written by unthinking Democrats or others who believe Farrakhan that Obama is anointed by God.

Maybe Obama is not hiding anything. Maybe he is a natural born citizen. Maybe there is nothing embarrassing on the original Certificate of Live Birth. But that's precisely the point. If there is nothing out of order, produce the document. Why fight in court to keep the document in the dark?

The courts are satisfied with the birth certificate. The courts are satisfied with the affidavits of Hawaiian officials related to this matter.

Obama fans, don't want to shock you but when Obama was running for his Senate senate, I was stationed in Hawaii. A friend, she was excited about this new senator candidate, told me he was born in Hawaii. During my visit at the hospital he claim he was born at, I did in fact looked up his mothers public record for birth in that period and could not find any. So I went to the second hospital and still could not find any record of his birth. Now I know you Obama fans are not going to believe this, but I know for a 'FACT' he was not born in Hawaii, because there was no "birth recordings" of his birth at any of these hospitals. Therefore unless he gets someone inside these hospitals to "develop" a birth recording then he has no proof of his birth in Hawaii. By the way if any of the "Obama Teams" staff try to contact me with threats, forget it, my affadavit along with my voice analyst is locked in a safe place. FOR THOSE OF YOU WHO DON'T BELIEVE ME, ESPECIALLY IF YOU LIVE IN HAWAII, I STRONGLY RECOMMEND THAT YOU LOOK YOURSELF. Consider the date of the presented birth certificate. It is printed upon a 2001 revised edition. Therefore, where is the original application for the print copy. This is required for individuals to join the military, at least it was in 1983. Secondly, take what the constitution states into account. Do not make it state what it does not!

Here's an unexplored way to settle the dispute over Obama's birthplace and citizenship: Look through Stanley Ann Dunham's (Obama's deceased mother) personal effects to find her passport that covered 1961. (You do keep your old, expired passports don't you?). This passport would prove conclusively whether Stanley Ann Dunham was on Kenyan or American soil during August 4, 1961.

But why go through this trouble when Obama should be able to EASILY produce a bona fide birth certificate that names the Hawaiian hospital he was born at, thus PROVING CONCLUSIVELY that he was born in Hawaii -- on American soil -- as he steadfastly claimed? WHAT COULD BE SIMPLER?

Still, what if this passport cannot be found? Would suspicions arise that Obama had previously arranged to make this passport disappear? Guess who could easily stop these suspicions from arising in the first place?

I like to remind everyone that this issue concerning Obama's citizenship is NOT about Obama, but about the U. S. Constitution. And I don't care what he tells Oprah!

I disagree. Just look at the blogs of the people who have created their own unique definition for "natural born citizen". It is ALL about Obama, and his supposed ties to radicals and his supposed plan to make the country socialist and how he MUST BE STOPPED. There have always been some racists and anti-immigrant groups who don't like the idea of the children of foreigners being citizens (heaven help us if one became president), but that is not what has turned a fringe smoldering wick into a forest fire.

The only reason dumb people think dumb things like this is B.S. is because they are dumb. If Hawaii said he was born there, then why not release his original birth certificate. He was born in Kenya. He is not eligible to be president and he is not qualified anyways. He was in the Senate for what three years, most of which he spent campaigning for president.
