Judge throws out lawsuit against LAPD rule on immigration queries

A judge Wednesday threw out a lawsuit filed by a Los Angeles resident who wanted to repeal the long-standing LAPD Special Order 40 that restricts when police officers may ask people about their immigration status.

The spotlight fell on Special Order 40 after the murder of Jamiel Shaw II. He was allegedly gunned down by a reputed gang member who was in the country illegally. The suspect, Pedro Espinoza, had been released from jail the day before the slaying.

Los Angeles County Superior Court Judge Rolf M. Treu, granting a motion from the city and the American Civil Liberties Union, said Harold Sturgeon had failed to prove that Special Order 40 was in conflict with federal and state laws that dictate the flow of information between local and federal agencies regarding people's immigration status.

I'm commenting to show that not all Republicans and conservatives are regressive racist troglodytes. I support Special Order 40. It's good for policing. It makes sense.

Immigration is a serious issue that requires a thoughtful comprehensive solution, starting with border enforcement and ending with a sensible way of bringing those into the country into compliance with our laws. The anti-immigrants are a very vocal minority that has roused ordinary Americans, but everyday they reveal themselves as unAmerican racists who blame EVERY problem on immigrants, both legal and illegal.

We've seen them many times in our country's history. First it was the Irish and Chinese that were persecuted and marginalized. Many groups have suffered since.

My family first came to Los Angeles in 1902. I remember that we were at one time immigrants and suffered discrimination. So I know racism when I smell it and let me tell you, the anti-immigration movement stinks.
