Octuplet mother Nadya Suleman loses court bid to block guardian for children

August 21, 2009 |  1:26 pm
Suleman

An Orange County judge today rejected an effort by octuplet mother Nadya Suleman to prevent an independent guardian from reviewing the finances of her 14 children.

The judge ruled that county social workers should now review a request by a former child star that a guardian be appointed to monitor the money the children receive from various media projects.

Last week, the state's 4th District Court of Appeal stayed a lower-court ruling siding with Paul Petersen, who took Suleman to court over the issue.

Petersen, known for his role on "The Donna Reed Show," is an advocate for children in the entertainment industry. He alleged that video shot of Suleman's children violated a law aimed at protecting child entertainers from overwork. The suit seeks to create an independent trust for the children.

A day after Fox show, octuplets' mom Nadya Suleman in court over money

Nadya Suleman is scheduled to be back in court today, hoping a judge will throw out an attempt to have an independent guardian review her children's finances.

The hearing comes a day after Fox broadcast a prime-time documentary about her life since giving birth to octuplets. Much of the footage came from Radar Online, which filmed Suleman for months. At one point in the documentary, she says: "I screwed up my life. I screwed up my kids' lives. ... What was I thinking?"

The court case focuses on the money her children receive from such filming.

Last week, an appeals court sided with Suleman in her legal battle with a former child star over whether Suleman's 14 children should have an independent guardian to protect their finances.

The 4th District Court of Appeal stayed a lower-court ruling siding with former Disney Mouseketeer Paul Petersen, who took Suleman to court over the issue. Last month, an Orange County judge agreed to appoint a guardian to examine the finances of the children.

Octuplets' mom in court fight over filming children

July 27, 2009 | 12:01 pm

Octuplets' mother Nadya Suleman will face off this afternoon with an advocate for child actors in a court battle over whether a judge should appoint a conservator to look after her children's financial interests.

A child-labor activist has filed suit against Suleman in Orange County Superior Court, alleging that video shot of her children violates a law aimed at protecting child entertainers from overwork. The suit seeks to create an independent trust for the children.

But Suleman wants to throw out the lawsuit. The hearing is set to begin at 3 p.m. at an Orange courthouse.

Suleman, already a mother of six, made headlines in January when she gave birth to eight children. Radar Online and other media organizations have shot video of the children, and Suleman has been in discussions to be the focus of a reality TV show.

In a separate legal matter, state labor officials last month cited Radar Online for failure to obtain an entertainment permit, failure to have an entertainment permit on file, failure to have a studio teacher on site and allowing the babies to be available for filming beyond the hours allowed. The website has been chronicling Suleman's life in recent months. The accusations involve one day of filming -- March 17 --  when the first two of Suleman's eight babies were brought home from the hospital to a media frenzy.

Octuplets mother Nadya Suleman trying to end new legal dispute over children

July 22, 2009 |  7:51 am

Octuplets mother Nadya Suleman is hoping to put an end to a legal battle involving video shoots of her 14 children.

A child-labor activist has filed suit against Suleman in Orange County Superior Court, alleging that video shot of her children violates a law aimed at protecting child entertainers from overwork. The suit seeks to create an independent trust for the children.

But Suleman has filed court papers in Santa Ana seeking to throw out the lawsuit. A judge will decide at some later point whether to grant the dismissal request.

Suleman made headlines in January when she gave birth to eight children (in addition to six she already had).

'Octomom' art installation has Whittier talking

June 24, 2009 |  2:53 pm

Octwhit

Back in February, the world's media converged on Whittier hoping to get a glimpse of octuplets mother Nadya Suleman and her 14 children.

Suleman The press moved on when Suleman took a home in nearby La Habra. But the legacy of "Octomom" lives on at the Gold Mine VW Auto Parts building along Pickering Avenue in Whittier.

There, drivers can’t help but chuckle at a display owners Ralph and Diva Chase have set up. Mounted on the wall of the building is half a grabber-blue 1969 Volkswagen Beetle. Inside, a black-hair mannequin -- respectfully named Teri, not Nadya --  is sitting with her legs crossed and is surrounded by babies. A box of diapers sits on the bug’s roof.

Ralph Chase said his 22-year-old niece, Jenna White, put the display together, meant as a tribute to Suleman and her mark on Whittier.  “She’s Teri’s stylist,” he joked.

They sometimes change Teri's clothes to freshen her look, and some people have come by to donate clothes for the display.

Chase said that the display had slowed traffic and that a few customers had inquired about the installation. He said he had not heard from the Sulemans.

This is not the only piece of Octomom art. "Octomom: The Musical" is supposed to debut soon. The show include a scenes between Octomom and her doctor, in which she ponders during a moment of weakness, "I need the man, and not the seed."

Octuplet-tracking website broke labor laws, state agency says [Updated]

June 16, 2009 | 11:23 am

State labor officials have cited the entertainment website that has been chronicling the life of octuplets mother Nadya Suleman and her children, officials told The Times.

RadarOnline is cited for failure to obtain an entertainment permit, failure to have an entertainment permit on file, failure to have a studio teacher on site and allowing the babies to be available for filming beyond the hours allowed.

The accusations involve one day of filming -- March 17 -- when the first two of Suleman's eight babies were brought from the hospital home to a media frenzy.

Officials said the investigation was ongoing. The four citations involve six violations and carry a $3,000 fine, said Dean Fryer, spokesman for the California Labor Commission.

Officials at RadarOnline could not be immediately be reached for comment.

[Updated at 1 p.m.: The single mother catapulted onto the public stage after giving birth on Jan. 26 to the world’s longest-surviving set of octuplets. She immediately became a focal point for populist rage after it was learned that she was jobless, unmarried, on welfare and already had six children. All 14 of her children were conceived through in vitro fertilization.

Under the state’s labor code, RadarOnline should have obtained an entertainment permit for filming any child age 15 days to 18 years old. Fryer said they did not obtain one for that day, nor did they have one on file. In addition, filming is only allowable for 20 minutes per day between the hours of 9:30 a.m. and 11:30 a.m. and 2:30 p.m. and 4:30 p.m., Fryer said.

On March 17, filming took place late that night as Radar accompanied Suleman from the hospital to her La Habra home. They were chased by phalanx of paparazzi, and when they arrived home, the scene outside resembled a rock concert. Helicopters flew overhead, dozens of camerapeople from around the world, along with hundreds of curious onlookers mobbed her cul-de-sac, prompting more than 200 calls to 911, including one from Suleman herself.

“They were brought home late in the evening, so it would have been beyond the hours set in the Labor Code,” Fryer said. “They were filmed in the home of Nadya Suleman. RadarOnline had control of the environment there. Our understanding is that they rearranged the furniture to set the scene. They set the lighting.”

The state codes also require that RadarOnline have a teacher on site. In the case of infants, that teacher would be responsible for overseeing the babies moral well-being, safety and health, Fryer said.]

'Octomom' joins the English language -- but who owns it?

June 10, 2009 | 11:19 am

Suleman "Octomom" has gained a level of respect -- at least the word has.

The Global Language Monitor announced that "Octomom" has been added to its list of English words and phrases. It came in at word 99,993 -- in the same list as "Slumdog," "Web 2.0," "Sexting" and "Slow Food."

So what is the definition? Here it is: Octomom – The media phenomenon relating to the travails of the mother of the octuplets.

"Octomom," of course, is Nadya Suleman, who gave birth to eight babies at a Bellflower hospital in January. She and all 14 of her kids now live in a La Habra home.

Back in April, Suleman attempted to claim trademark rights to the "Octomom" name. Her attorney said at the time that Suleman didn't like the nickname but saw it as a way to provide for her children.

But it turned out a Houston novelty company had already filed a trademark on the word. At the time, Suleman's attorney said she would still make the claim to the name, adding she should have legal rights to "Octomom."

Father of octuplets was 'upset' when he learned of pregnancy, Nadya Suleman says

June 4, 2009 |  3:31 pm

SulemanOctuplets mother Nadya Suleman told an online celebrity website that she wants her children to have a father in their lives but that the man was upset and resentful when he heard about her pregnancy.

"I want to apologize to him, but I feel like he resents me," she said.

Suleman, who gave birth to eight children in January after undergoing fertility treatment, has not identified the sperm donor and has said in the past that she feels judged by the public for being a single mother.

In an interview with Radar Online, she said she used sperm from the unidentified donor to have her first six children. He did not know she had additional embryos and was "upset" when he found out she was pregnant with eight more babies, Radar said.

"That was my problem. That was my choice. That was my stupidity," she said. "I went behind his back and used them all. He didn't want me to. I feel so much guilt for that."

“I screwed myself. I screwed up my life. I screwed up my kids' lives,” she added in the video.

Octuplets mom tells Kate of 'Jon & Kate Plus 8': Stop judging me

June 2, 2009 |  7:44 am

Octuplets mom Nadya Suleman  isn't happy with comments made by another mother of many kids, "Jon & Kate Plus 8" star Kate Gosselin.

Gosselin was interviewed earlier this year on the "Dr. Phil" TV show and was asked about Suleman's situation. She said it was going to be difficult for Suleman to raise 14 children, particularly without a husband to help out with parenting.

"Do I have to watch it? She reminds me of my mother," said Suleman, a resident of La Habra, in an interview with Radar Online released this morning. "I have moved past my mistakes. She has her own issues. ... She needs to stop being so judgmental and stop pulling at straws for attention."

"Jon & Kate Plus 8" is a popular reality TV show that follows Gosselin and her husband as their raise eight children. The show has gotten much publicity in recent weeks amid reports of marital troubles between the couple.

Suleman said in the video interview that Gosselin should focus on her own life. "My children are extremely healthy, strong and happy. Don't you have, like, a lot of issues in your life? A lot of marital problems?" she told Radar.

Coincidentally, Suleman's attorney announced this weekend that Suleman had signed a deal to star in her reality TV show.

"They came up with this idea, presented to her and she liked it because she'll get to use a camera and do some of the filming herself," her attorney, Jeff Czech, told the Associated Press, adding that the film crew would  not follow the family all the time but, rather, cover certain milestones like birthdays.

"It'll be less intrusive than a reality-TV type of program," Czech said.

Privacy breach in octuplets case costs Kaiser $250,000

May 15, 2009 |  9:49 am

California health regulators have fined Kaiser Permanente's Bellflower hospital $250,000 for failing to keep employees from snooping in the medical records of Nadya Suleman, the mother who set off a media frenzy after giving birth to octuplets in January.

The fine is the first monetary penalty imposed and the largest allowed under a new state law enacted last year after the widely publicized violations of privacy at UCLA Medical Center involving Farrah Fawcett, Britney Spears, California First Lady Maria Shriver and other celebrities.

Octuplets' mom Nadya Suleman to have surgery

May 13, 2009 |  7:24 am

Octuplets' mother Nadya Suleman is reportedly scheduled to undergo surgery this week to remove uterine fibroids.

Suleman said she's receiving a myomectomy. According to the Mayo Clinic website, a myomectomy "is a surgical procedure to remove uterine fibroids — noncancerous growths of the uterus that often appear during your childbearing years. The surgeon's goal during myomectomy is to take out symptom-causing fibroids and reconstruct the uterus. Unlike hysterectomy, which removes your entire uterus, myomectomy surgery removes only the fibroids and leaves your uterus intact."

Suleman insisted that she will still be able to bear children.

"I am not having all of my uterus removed," Suleman told Radar Online. "Actually, it enhances fertility. It doesn't reduce it. If I really wanted to become pregnant, I could. But I wouldn't. That's the truth."

Octuplets mom 'exploiting' children, Gloria Allred claims as she files court petition

May 4, 2009 |  2:49 pm

Los Angeles attorney Gloria Allred announced today that she has filed a petition in Orange County Superior Court seeking a guardian to protect the financial interest of Nadya Suleman’s octuplets.

"Rather than choosing to provide her children with a normal life, their mother, Nadya Suleman, has chosen instead to commercially exploit them,” Allred said in a statement. “We believe that the babies are entitled to remuneration, since much, if not most, of the compensation appears to be for the use of their images.”

Since bringing her babies home from the hospital, Suleman has allowed them to filmed on the celebrity website Radaronline, and a photo agency has released their images for sale. Suleman has also talked of signing a contract for a reality television show about her life raising octuplets and her six other children, and she had her “Octomom” nickname trademarked.

Allred, on behalf of her client, Paul Peterson, the president of “A Minor Consideration,” a nonprofit formed to give support to young performers, is seeking an order that would create separate bank accounts for the babies’ earnings and require Suleman to hire a professional agent for the babies, separate from her own agent.

Allred earlier represented nurses who filed complaints with child-welfare officials alleging that Suleman’s home was not safe for the children. The nurses from Angels in Waiting began working with Suleman after a deal brokered by talk-show host Dr. Phil McGraw. But the deal fell apart after Suleman complained that the nurses were spying on her. The nurses later held a news conference and discussed their concerns, which included complaints that Suleman allowed dirty television cables in the nursery.

Allred also said that she had sent a letter to the California Division of Labor Standards Enforcement requesting an investigation into whether Suleman had broken California laws regulating child performers.

Suleman could not immediately be reached for comment.

Social workers, police quiz octuplets' mom about son's black eye

April 29, 2009 |  7:04 pm

Orange County children's services officials and La Habra police detectives visited the home of octuplets mother Nadya Suleman today after her 4-year-old son went to school with a black eye.

Suleman told Radar Online that the injury was minor, adding: “He’s autistic; he bumps into things.” She also told the online celebrity news site that the boy had some bite marks on his body.

The visit is the latest twist for Suleman, who is living in her new La Habra home with 14 children.

Suleman's attorney, Jeff Czech, told the Associated Press that he was not sure whether the social services officials took any action and said he suspects that they were called by the boy's teacher.

Czech said the boy likelyy got the black eye in a fall and that the bite marks probably came from another of Suleman's children.

Radar described the visit this way: "Preparing to pick up her older kids from school on Wednesday afternoon, [Suleman] was paid a surprise visit by the Orange County Social Services Agency-Children and Family Services and two La Habra detectives. Sitting in Suleman’s living room, the officials had to put a hold on their inquiries, promising to return when Suleman came home from the errand."

'Octomom' seeks trademark

April 15, 2009 |  6:30 pm

Octuplet mother Nadya Suleman is seeking to trademark her nickname – “Octomom” – according to two applications filed with the U.S. Patent and Trademark Office.

The applications, filed April 10, say that the trademark would be used  for selling disposable diapers and for “ongoing television programs.”

According to Life & Style magazine, Suleman confirmed that she has reached a deal with a British company to film her children six times a year until they are 18 for a show that will air in Britain.

"They’ll come by and take some footage and then they’ll go,” Suleman told the magazine. “They won’t be invading my life or my children’s lives.”

Suleman’s attorney, Jeff Czech, said the deal has not been finalized.

“We’ve been contacted by four or five companies and some stations, but we’re in negotiations,” he said. “There is no deal.”

At least one other trademark application for Octomom has been filed. Super Happy Fun Fun, a Texas-based corporation, submitted its paperwork March 12, to use the name for computer game software, toys and action figures and wireless and mobile entertainment.

The company’s website indicates that it has developed the Fertile Myrtle game that requires players to “press down on Fertile Myrtle’s swollen belly, and another adorable bundle of joy will be brought into the world.”

Each extra baby earns welfare money, with bonuses given for birthing in front of the paparazzi, the website states.

Czech said he has not yet decided how to handle the competing application, but said, “Octomom is clearly a nickname for only one person.” Suleman has no other merchandising deals, but Czech said he encouraged her to file the applications to protect herself.

Last of octuplets arrives home in La Habra

April 13, 2009 |  9:41 pm

The Associated Press is reporting that that the last of Nadya Suleman's octuplets arrived home in La Habra today. Here's the story:

Nadya Suleman has all her babies home.

The last of the world’s longest-surviving set of octuplets was released from the hospital Monday night after spending more than two months in the neonatal intensive care unit.

Jonah, the smallest of the octuplets who were born nine weeks premature on Jan. 26, has gone home to join his brothers and sisters, Socorro Serrano, a spokeswoman with Kaiser Permanente Bellflower Medical Center said. They include six older siblings ages 2 to 7.

Jonah was the smallest of the octuplets at birth, weighing just 1 pound 8 ounces. The hospital says he is now 4 pounds, 10 ounces, is able to bottle feed and has demonstrated that he can gain weight and maintain his body temperature.

“He stayed a little longer because he needed to gain weight,” Serrano said.

The octuplets’ birth was heralded as a medical miracle, but the public’s fascination with Suleman quickly soured as details of her life emerged. The divorced and unemployed mother had six other children at home; she has said all 14 children were conceived through in vitro fertilization.

Media scrutiny grew and the first pair of infants to go home were greeted March 17 by a crush of reporters and photographers in Suleman’s home in La Habra, about 25 miles east of Los Angeles. The remaining babies went home in secret, at Suleman’s request.

A team of nannies, who were trained and evaluated by Kaiser Permanente nurses, are helping Suleman care for the children.

“Kaiser is comfortable with the level of care they’re providing for the babies,” Serrano said.

Octuplets' mother says kids still receiving public assistance, might seek more

April 9, 2009 |  8:15 am

Octuplets' mother Nadya Suleman said some of her children continued to receive government assistance but that her goal was to "get off of them."

In a video interview with the Whittier Daily News, Suleman said some of her children continued to receive Medi-Cal but she hoped that would end once she finished school and got a job. She said she was considering using another government program, WIC, to get baby formula for her eight newborns. Suleman said the formula would cost $2,000 a month otherwise.

She said she no longer took food stamps for her children.

"I have to let go of what people think," she told the newspaper. "I can't live like this."

Since giving birth to octuplets, some media experts have said, Suleman and her family have made some money granting interviews, giving reporters access to the babies and selling photos. It's unclear how much, though she said she used some of that money to pay for the La Habra home she now lives in.

Some publications have reported that Suleman has been talking with some producers about starring in a reality TV show, though Suleman in the newspaper interview seemed to indicate that is not true.

Octuplet mom hires security after child seat is hurled into her minivan [UPDATED]

April 1, 2009 |  4:20 pm

Octuplet-mother Nadya Suleman has hired security guards, her attorney said Wednesday, the day after someone hurled a car seat through the window of her minivan that was parked outside her home.

La Habra police said a nanny heard the sound of a crash about 3 a.m. When the day-shift nannies arrived about 7 a.m., they saw the van’s window had been smashed.

Police have no suspects.

Suleman has complained about the crush of paparazzi and gawkers since she moved to La Habra last month.

Updated, 4:55 p.m.: The seventh of Nadya Suleman’s eight babies has been released from Kaiser Permanente Medical Center in Bellflower. Hospital officials confirmed that Josiah Angel, also known as “Baby G,” was released Wednesday afternoon. He weighs 4 pounds, 8 ounces. “Every day that passes is a milestone in the lives and care of the octuplets,” said Dr. Mandhir Gupta, the octuplets’ neonatologist. “Being able to send another baby home is a significant step in their development.” Only one more baby remains hospitalized and continues doing well, a hospital spokesman said.

Octuplets mom has tough balancing act with media

March 31, 2009 |  4:52 pm

Suleman Nadya Suleman has repeatedly pleaded with the paparazzi to leave her and her 14 children alone. But the mother of octuplets has a much more complex relationship with the media than, say, A-list celebrities trying to maintain their privacy.

Almost from the moment she gave birth, those close to her say, Nadya Suleman understood one thing: in order to provide for her family, she was going to have to sell their story. And Suleman has been selling. For nearly a month, she’s been the star of regular “video diaries” on celebrity website Radaronline. Suleman has appeared on Dr. Phil numerous times, and escorted “Dateline NBC” and “The Insider” into the hospital to see her babies.

On Tuesday, the New York photo agency Polaris Images began selling glossy posed photos of Suleman and six of her octuplets inside her La Habra home. (Some media outlets say they have not paid her anything; others, such as Polaris, declined to comment.)

But in recent days, Suleman has also been getting some unwanted attention.

Hospital workers fired for spying on Suleman's files

March 30, 2009 |  9:39 pm

The Octomom saga took a new twist tonight with word that some workers at the hospital where Nadya Suleman gave birth to octuplets snooped on her medical records. This has happened before at L.A. hospitals where celebrities are treated. And officials have vowed to improve controls.

[Updated: Check out Julie Cart's story in The Times]. Details from AP:

Fifteen hospital workers have been fired and another eight disciplined for looking at medical records of octuplet mother Nadya Suleman without permission, hospital officials said Monday.

Kaiser Permanente reported the violations of healthcare privacy laws to the state and has warned employees at its Bellflower facility to keep away from Suleman’s records unless they have a medical purpose, said hospital spokesman Jim Anderson.

Octuplets mom: Babysitters spied on me

March 24, 2009 | 12:24 pm

Suleman Just hours after welcoming home two more babies, octuplets mother Nadya Suleman fired a nonprofit group of nurses hired to care for her children.

Suleman accused the group, Angels in Waiting, of spying on her and reporting her to child welfare officials, said Suleman attorney Jeff Czech. The group had been training nannies who were paid by Suleman, who had six children before giving birth to octuplets.

Mother of octuplets won't accept group's child-care help

March 23, 2009 |  3:31 pm

Suleman Octuplet mother Nadya Suleman plans to stop using the nursing care and baby-sitting services of Angels in Waiting, the nonprofit that had offered to provide care for her newborns and her six other children. Instead, Suleman told Radar Online, she plans to hire her own baby sitters.

Angels in Waiting, a nonprofit founded by a pediatric nurse, had offered to help Suleman care for her babies. But it turned out the nonprofit did not have the funds to do that on its own but would have had to raise them. Suleman initially rejected the offer, then, after an intervention from television host Dr. Phil McGraw, accepted it for the first few days that some of her children were home.

Now, with four of her octuplets at her new La Habra home, she is apparently poised to make a new child-care arrangement. Gloria Allred, the attorney for Angels in Waiting, declined to comment. Radar Online also said that members of Angels in Waiting were scheduled to tape an episode of "Dr. Phil" tomorrow, and that Suleman was concerned the organization would criticize her. The website said she hopes to appear on "Dr. Phil" in person to tell her side of the story.
