Man guilty of sexually assaulting relative's child on Christmas Eve

An Orange County jury on Monday found a 38-year-old Santa Ana man guilty of sexually assaulting a relative's 8-year-old child on Christmas Eve 2009, prosecutors said.

Jorge Miguel Gallegos was found guilty of multiple felony counts, including sexual intercourse or sodomy with a child, lewd acts on a child under 14 and dissuading a witness from reporting a crime. He faces a sentence of 55 years to life to 66 years to life in state prison at his sentencing May 11.

The attack occurred when Gallegos took the child into the kitchen of his Santa Ana home after other family members had gone to sleep, prosecutors said. He then sexually assaulted the child.

Gallegos' wife walked into the kitchen and witnessed the incident.  Authorities said Gallegos ripped the telephone from the wall and threatened his wife not to tell anyone about the attack. He then fled to a friend's home.

His wife called police and Gallegos was arrested Christmas Day.

Investigators later discovered that the child had been attacked by Gallegos a few months or weeks before the Christmas Eve incident, prosecutors said.
