Fatal police shooting of man with BB gun under review

Authorities said they are investigating the fatal shooting of a 35-year-old Anaheim man who was walking around an apartment complex with what turned out to be a BB gun.

Bernie Cervantes Villegas was walking around the apartment complex on West Ball Street at 11 p.m. Saturday when several people called police to report the man was carrying a shotgun, Anaheim Police Sgt. Bob Dunn said.

Villegas, whom police said they encountered at the rear of the complex, was shot and pronounced dead at the scene, authorities said.

No injuries were reported.

The weapon recovered by police was initally believed to be a rifle but later turned out to be a BB gun, Dunn said.

The Orange County district attorney's office is investigating the circumstances surrounding the shooting, KTLA-TV Channel 5 reported.
