Kyle Pearson, 42, fell or jumped from the structure Monday afternoon as hundreds of Occupy San Diego protesters were camped out in the plaza, police said. He was declared dead at the scene.

Pearson was charged with vehicular manslaughter in the June 1 death of a CalTrans worker on Interstate 8, authorities said. He was set for a pretrial hearing Oct. 18 in Imperial County Superior Court.

Imperial County authorities believe he was driving while drunk when he hit CalTrans workerJaime Obeso and then fled.

Pearson was not thought to be part of the Occupy San Diego movement. He was carrying fliers saying, "Important Message for Intelligent Earthlings From Your Creator."
