Lindsay Lohan offered plea deal of 90 days in jail in jewelry theft case, source says

Actress Lindsay Lohan faces a preliminary hearing on allegations she stole a $2,500 necklace from a Venice jewelry store unless she accepts an offer of no more than 90 days in jail if she pleads guilty to grand theft, according to a source familiar with the case.

Despite the offer last week by Los Angeles Superior Court Judge Keith Schwartz to Lohan's lawyer, the actress has so far refused to consider any time in jail and has insisted she never took anything intentionally, the source said. If need be, she will go to trial, according to the source.

While Schwartz initially said Lohan would have a deadline of March 10 to resolve the case in his court, last week he set an interim court date of March 25.

He told the "Mean Girls" actress she would either show up on that date, enter a plea and get some jail time or not appear at all and the case would be set for a hearing before Judge Stephanie Sautner. The hearing would determine whether there is sufficient evidence to try the case.

Schwartz warned Lohan that Sautner would hear the jewelry theft case while also considering whether the conduct amounted to a violation of Lohan's probation on a 2007 misdemeanor drunk-driving conviction.

Sautner could jail Lohan on the probation violation if she finds the actress in violation even before a trial on the Jan. 22 alleged necklace theft.

Schwartz previously warned Lohan any settlement would result in her going to jail. He also said she would need to enter court-supervised therapy and have a 12-step program sponsor independent of her family and friends.

90 days for stealing a $2500 necklace? What kind of time would Blanca or Kenisha get for the same thing?

And how much of my tax dollars are they spending on this person?

She is no different then anyone. She should be treated the same. The law is the law. The necklace didnt just magically appear in her hands. She took it. In fact she didnt pay for it. I dont know any reason for her not to be locked up for some time. If I was the judge man her ass would be soooooo locked up. Just because Lindsay Lohan is a celebrity makes no difference. She broke the law. Do the crime and do some time!!!!

I knew the threat of jail time would catch her ear. She needs to be near a source of her drug of choice. Now her money has found a listener in the DA's office?

She better take that 90 days....She'd be out in a month. He can't make her have a sponsor, though...

I'm not sure what it says about the state of LL's career when the LAT refers to her as "the 'Mean Girls' actress," but it can't be very good.

it was quite clear in the video that she didnt steal it. The clerk was laughing even opening door for lindsay. If you lend someone a necklace, the first thing you do is ask for it back, not sue her.

Someone wants Lindsay's spirit broken.

I hope she gets justice. What if we were her? We should stand up for her. This is not justice.

90 days is wino time, she'll do 3 weeks... maybe 2! She should take the wino time and beat the traffic. If she goes to Probation hearing, she's cooked! Same judge will do the Probation Hearing and hearings go by a "preponderance of the evidence" as opposed to "guilty beyond a reasonable doubt", two different burden of proofs. Hearsay is admissable in a hearing whereas in a trial it is not. In short if she does not take the deal, she's going to jail, probally for the max, 1 year county jail (really hard time, state prison is much easier...)

"Entertainment Tonight" is a suck-up to Hollywood and has an agenda for springing Hollywood criminals loose.

Can we make her plea deal to leave Los Angeles and quit trying to act?
