Bench warrant issued for Lindsay Lohan, probation revoked

A bench warrant has been issued for Lindsay Lohan after she tested positive for drugs, but court officials said she won't be taken into custody until at least Friday after a court hearing.

Beverly Hills Superior Court Judge Eldon Fox will decide at that time whether Lohan violated her probation and should be sent back to jail or back into locked-down drug rehab. The L.A. County Probation Department delivered its report on the alleged violation to Fox -- and her probation was revoked.

Lohan admitted on her Twitter feed that she failed the test. "Regrettably, I did in fact fail my most recent drug test and if I am asked, I am prepared to appear before judge Fox next week as a result," she wrote. "This was certainly a setback for me but I am taking responsibility for my actions and I'm prepared to face the consequences."

Lohan spent part of the summer in an L.A. County jail in Lynwood after repeatedly violating the terms of her probation on a drunk-driving charge. She was released from a rehab center a few weeks ago.

Under the terms of her sentence, if she misses a test or gets a positive result, she would face 30 days in jail.

Lohan continues to undergo intense therapy and counseling since her release from a UCLA rehab facility. She is on supervised probation in connection with her 2007 conviction for driving under the influence.

As part of her plea arrangement, she must take random drug tests twice a week. After her most recent stint in jail, Lohan had said she was trying to get back to acting.

She told Vanity Fair that her jail stint taught her that she needed to stop surrounding herself with people who lure her into trouble.

"So many people around me would say they cared for the wrong reasons," she told the magazine. "A lot of people were pulling from me, taking from me and not giving. I had a lot of people that were there for me for, you know, the party."

She can stay with me for two years.

Unfortunately she was treated very well in jail and has no fear of going back. I think the judge should give her community service at CALTRANS and picking up trash on the freeway.

The "game she is playing" is called addiction and it's not that easy to just stop. Just because she's a celebrity doesn't make her immune from the grip of addiction, it just makes her more vulnerable to having people around her to encourage and enable her, and the money and status to get virtually anything she wants at any time- and the constant press can't help. Is it so surprising then that she's failed her drug test? I'm saying this from the perspective of someone who was once in active addiction but has now been clean for a few years. Rehab doesn't work for everyone (it only worked for me for the length of time I was in the safe bubble of a treatment center, once you get back out into reality it's a whole different story. You have to be ready to stop) and jail certainly doesn't either, but of the two options I think she should be put in a locked-down treatment center. Am I the only one that has empathy for someone who is obviously an addict and in need of help?

Why not make a deal with the authorities - tell from whom she obtains her drugs.

Oh, wait. She probably would never work again - have to wait until she is 63 to get social security or live on SSI until then.

She is another person who has been given several chances. I believe that people should be given a chance to straighten themselves before being punished will jail time. Unfortunately, she has been given several chances already and yet nothing seems to work.

What is wrong with you girl? Have you no sense? Don't you realize that mandatory drug testing is part of your parole?

I am sorry, but you do deserve to be under lock and key, whether it is in a "lock down" rehab facility or in jail.

You can do a "Paris Hilton" and cry and whine all you want, but you brought this own ruin upon yourself.

Okay, yes she failed a drug test, and yes this has gotten much more publicity than it needs. This is one of the hardest things she will face as an adult; fighting an addiction. Does she crave attention? Hello, she’s an actor; that’s why people become actors.
But have some compassion for a human being locked into what very might be a life and death struggle with her demon.
If a soldier came back addicted because of the war, you’d cut them a break, wouldn’t you?
Well she’s in her own little war; made worse because it’s internal. Remember too that she didn’t grow up in the best of situations (yes I know there was lots of money; doesn’t mean a stable home life)
So Lindsey, I wish you grace and strength and I hope you beat this.

thecanimalshusband: How you are able to segue a discussion on Lohan and Hilton into George Bush is baffling, befuddling, without amusement, and completely inappropriate to the news article.

I'm sure she's real scared about going to jail for 30 days. With the overcrowding issue...she'll be incarcerated for what.....3 hours?

Until the criminal justice system actually incarcerates people for the length of time they are sentences, these little celebrities will continue to laugh and play games with their health and the general public's lives.

I feel sorry for her, her whole family is screwed up and she's the one that is making it worse by allowing bad people in her life. The judge needs to treat this as it is a probation violation, anyone else would get sent back to jail and so should she. Needs to realize there are consequences to all the drugs/partying and law breaking she's doing. Jail time.

arent there some other unemployed actors that are as good or better? can they just be subject to the hollywood machine to be blown up to instant overnight celebs - thereby making money for studios just the same? Lohan is not that interesting anymore, instead its just another junky but with so so many privledges and second chances. in most other significant careers (those that pay big money outside of hollywood and pro-athletes) you just dont get ANY second chances. its a bad message to young people that all of this is OK, it just makes our society that much worse b/c people want to act and be like her.

Her judge will not be amused ... Lohan is about to receive a legal spanking she will not forget ... spoiled lady about to meet her determined match in court ... long overdue, and just may save her pampered little life.

Um, not intense enough if she is out partying and doing drugs and sipping vodka? And it can't be very supervised either. DUMB

How are drug tests random if they are scheduled twice a week? Come on, now, that's more of a "predetermined testing regiment" than a random occurrence. Let us all hope Lindsay manages to get her life back on track before she end up going down the same path as Brittany Spears and Paris Hilton-- Sleazy, burnt out junkies. She has the potential to be a great public figure, but she HAS to start picking better friends. A good suggestion?? Get put on medical marijuana for harm reduction (help break the habit of the 'caine) and seriously-- the crowd she'd fall into with that is a MUCH better influence than cokeheads, though a bit more laid back......

For a society as advanced as we are, we sure are stupid in many instances. I am not here to defend this young lady's actions, but I will say that it is a proven fact that jail does not have any positive effect towards drug addiction. Here is what does have a positive effect, DRUG TREATMENT!!!!!! The main objective is to identify the intensity of treatment necessary. In this case, it my belief she needs to be in the most intense treatment offered anywhere. In the realm of addiction there are three results. Incarceration, hospitalization, and death. Guess which one of these three she has yet to achieve?
