Judge sentences Lindsay Lohan to jail [Updated]
A Beverly Hills judge ruled Tuesday that Lindsay Lohan violated the terms of her probation in a drunk-driving case when she failed to attend alcohol education classes and sentenced her to 90 days in jail.
Judge Marsha N. Revel stated several instances over the last few years in which the actress lied about taking drugs and drinking.
"It's like someone who cheats but doesn't think it's cheating if they don't get caught," Revel said.
[Updated at 3:47 p.m.: The judge said that Lohan had repeatedly deceived authorities following her first drunk-driving arrest in 2007. She said Lohan lied by pretending she was not the driver in that case. Two months later Lohan was arrested for drunk driving.
"Once again she lied about her driving," Revel said.
The judge said Lohan again lied when a white substance was found in her pants and tried to say they were someone's else pants. Revel said she tested positive for cocaine after the arrest.
"She lied then and lied prior to that," Revel said.
In addition to 90 days in jail, the judge sentenced Lohan to 90 days in a drug rehab center.]
Before sentencing, a tearful Lohan addressed the court, saying "as far as I knew I was in compliance with my programs.”
“I wasn’t trying to get special treatment," the actress said. "I have to provide for myself. I have to work. Having said that, I did everything to balance my jobs and showing up. I’m not taking this as a joke. It’s my life. It’s my career. ... I take responsibility for my actions. I’ve tried to do the best I can. It’s been such a long haul, I don’t want you to think that I don’t respect you.”
Prosecutors had argued that the star of "Mean Girls," "Freaky Friday" and "Herbie Fully Loaded" failed to comply with the weekly attendance directive for her alcohol education classes. An operator of the class testified that Lohan had nine absences.
Revel was critical of program operator Cheryl Marshall for failing to report Lohan's absences to the court before the actress had her bail revoked when the alarm on her alcohol monitoring device was triggered on June 6. That was the same night that Lohan attended the MTV Movie Awards.

Under questions from the prosecutor, Marshall told the court that Lohan did not sign in on some days the program claimed she had attended and that her signature was on a sign-in sheet on a day she did not attend. Marshall revealed Lohan never attended group meetings but opted for one-on-one sessions because of privacy concerns.
Defense attorney Shawn Chapman Holley argued that Lohan was "absolutely on track to finish the program" and had complied with most of the court's orders.
In considering her punishment, Revel said she considered whether Lohan violated her probation only for the actress' failure to attend some scheduled alcohol education classes, not because the alcohol-detection bracelet that Lohan was ordered to wear had been triggered following the MTV Movie Awards.
On June 8, Revel issued an arrest warrant for Lohan after the alarm on her monitoring device was triggered. The alarm typically sounds when the bracelet is tampered with or if the person wearing it consumes alcohol. The SCRAM device, or Secure Continuous Remote Alcohol Monitor, checks for traces of alcohol in the air above the user's skin.
Revel ordered Lohan to be fitted with the device May 24 after Lohan failed to show up the previous week for a mandatory progress review on whether she was abiding by the terms of her probation.

Ms. Lohan peaked in "Mean Girls." Her modicum of talent could take her to other roles, but she will have to work at it.
Her alternative is to end up like Corey Haim and others in Hollywood who end up as nothing more than junkies who seek publicity from a public bored with their behavior.

Actually, I believe that she was sentenced to both - 30 days jail time for her first DUI, 30 days for her second DUI, and 30 days for violating the terms of her probation, all of which are to run consecutively for a total of 90 days behind bars. Afterward, she is to report to rehab for a 90-day stint there.
Now, whether Ms. Lohan serves the full 90 days in jail is another question entirely, and will be determined by the court. My guess is that she'll maybe serve a quarter of that time, at the very most, because of the overcrowding situation at state and local correctional facilities.

Until Lindsey Lohan is forced to become a REAL PERSON She will never be able to deal with REAL LIFE. As long as she opts out of Group Counseling in favor of One on One Sessions For Privacy Reasons She doesn`t stand a Snowballs Chance in Hell of ever Having any kind of Usefull and meaningfull life.
She is constantly surrounded by people who are paid to Keep her in her Dream World. Her entourage of ASS KISSING YES MEN Allow her Addict Behavior. No one who is addicted has the ability to see themselves as they really are nor do they have the ability to function at any level in the real world while in their addiction all the while being told how Perfect and Fabulous, and Great they are. Now she`ll go to some Plush rehab surrounded by people like herself and will fail Miserably in her endeavor at Sobriety. She needs real Consequences like real people face daily. Until she is Removed from her High Horse she will continue her destructive path. She needs to have the Alcohol and Drugs thoriughly KICK HER ASS and until they do it will forever be all about Special Lindsey.There are some wonderfull State Funded Womens Rehabs in San Pedro That is what she Needs, real Recovery Side by side with Real Women who have Real Problems but have real HEART.

@name, and anyone else complaining about the actual time served: This just goes to show how little you know of the California criminal justice system. Due to budget constraints and jail overcrowding, convicted defendants don't ever serve the entirety of their sentence anymore. Instead, they get early release, or your so-called "vacation" incarcerations.
And even if a convicted defendant is sent to county jail or state prison, there is absolutely no guarantee that they will do time at the facilities they are sent to; often enough, they spend a good portion of their sentence in "processing" until there is vacant cell space in the designated facility.
If you want the guilty to do the time, you better be willing to pay for it.

She gets 90 days in jail and 90 days after jail for rehab. She has to want to fix this. The state has taken over for her parents. Well not much to say about them! I hope she can pull this off because this is want can kill her. She needs to grow up and become an adult woman. Playtime is over.

First and Foremost : Lindsay Lohan's lawyer Ms. Holley was the classiest act
to appear in court and argue a client's defense in a long long time .So very
focused,prepared, and the epitome of the consummate counselor. She did her very best, given the crash and burn addict she had to represent next to her, and what she had to work with. My grandfather practiced law for many years
in Washington,D.C., he would have given anything to have someone like Ms.
Holley in his law firm. And very pretty also. We will keep Ms. Lohan in our
prayers for her recovery.

Actuall, nb2010 she was sentenced to BOTH. She has to do the 90 days in jail (the LA County Sherriff can reduce it to 30 for "crowding") and THEN do the 90 days of inpatient rehab. No movies or awards shows for Lindsay for the next few months.

lohan has the opportunity to follow in the foot steps of those fallen celebrities who resurrected themselves and their career selves (Robert Downey Jr.). Will she and her team realize the possibilities that await? I am thinking she needs a needs a new agent.

I cannot tell if this is bad reporting or bad editing. Was she remanded to custody or will she report at some future date?

Who really thinks she will spend 5 minutes behind bars?? As to all who think she should be given a break, tell that to my 16 year old who will forever be in a wheelchair thanks to a 19 year old who was driving drunk (just a little over the "stupid" legal limit and spent less than 90 days in jail). By the way, he went on to have 2 more accidents due to drug use and never spent more than 6 months in jail. I just thank God he didn't hurt any one else.
