Judge sentences Lindsay Lohan to jail [Updated]
A Beverly Hills judge ruled Tuesday that Lindsay Lohan violated the terms of her probation in a drunk-driving case when she failed to attend alcohol education classes and sentenced her to 90 days in jail.
Judge Marsha N. Revel stated several instances over the last few years in which the actress lied about taking drugs and drinking.
"It's like someone who cheats but doesn't think it's cheating if they don't get caught," Revel said.
[Updated at 3:47 p.m.: The judge said that Lohan had repeatedly deceived authorities following her first drunk-driving arrest in 2007. She said Lohan lied by pretending she was not the driver in that case. Two months later Lohan was arrested for drunk driving.
"Once again she lied about her driving," Revel said.
The judge said Lohan again lied when a white substance was found in her pants and tried to say they were someone's else pants. Revel said she tested positive for cocaine after the arrest.
"She lied then and lied prior to that," Revel said.
In addition to 90 days in jail, the judge sentenced Lohan to 90 days in a drug rehab center.]
Before sentencing, a tearful Lohan addressed the court, saying "as far as I knew I was in compliance with my programs.”
“I wasn’t trying to get special treatment," the actress said. "I have to provide for myself. I have to work. Having said that, I did everything to balance my jobs and showing up. I’m not taking this as a joke. It’s my life. It’s my career. ... I take responsibility for my actions. I’ve tried to do the best I can. It’s been such a long haul, I don’t want you to think that I don’t respect you.”
Prosecutors had argued that the star of "Mean Girls," "Freaky Friday" and "Herbie Fully Loaded" failed to comply with the weekly attendance directive for her alcohol education classes. An operator of the class testified that Lohan had nine absences.
Revel was critical of program operator Cheryl Marshall for failing to report Lohan's absences to the court before the actress had her bail revoked when the alarm on her alcohol monitoring device was triggered on June 6. That was the same night that Lohan attended the MTV Movie Awards.
[Updated at 12:41 a.m. July 7: An earlier version of this post incorrectly said Lohan's alcohol monitoring device was triggered the night that Lohan had attended the MTV Music Awards.]
Under questions from the prosecutor, Marshall told the court that Lohan did not sign in on some days the program claimed she had attended and that her signature was on a sign-in sheet on a day she did not attend. Marshall revealed Lohan never attended group meetings but opted for one-on-one sessions because of privacy concerns.
Defense attorney Shawn Chapman Holley argued that Lohan was "absolutely on track to finish the program" and had complied with most of the court's orders.
In considering her punishment, Revel said she considered whether Lohan violated her probation only for the actress' failure to attend some scheduled alcohol education classes, not because the alcohol-detection bracelet that Lohan was ordered to wear had been triggered following the MTV Movie Awards.
On June 8, Revel issued an arrest warrant for Lohan after the alarm on her monitoring device was triggered. The alarm typically sounds when the bracelet is tampered with or if the person wearing it consumes alcohol. The SCRAM device, or Secure Continuous Remote Alcohol Monitor, checks for traces of alcohol in the air above the user's skin.
Revel ordered Lohan to be fitted with the device May 24 after Lohan failed to show up the previous week for a mandatory progress review on whether she was abiding by the terms of her probation.

There are other actors, directors, producers who are able to come back after drug and alcohol abuse and succeed because they have talent and skill. The thing about Lindsay Lohan is that she has no talent. She was cute as a child in the Parent Trap, did okay in Georgia Rules, but that's about all there is to her. My bet is that Lindsay will go the way of Tatum O'Neal. In a few years, she will start looking old, drained out, washed out, strung out and is on her way to being forgotten.

What a performance she put on in court today...fail

This will actually be good for her. She needs to be forced into a treatment facility. She's a drug addict that's in denial. I've seen this situation first hand with young people. Hard drugs eventually catch up to you and if you don't get intervention it will soon catch up to you and you WILL hit rock bottom. Let's hope she can recover from this and change her life around. We all deserve a second chance.

This gives her a chance to "Li Lo" for 3 months!

If Marsha Revel weren't a worse judge than Lindsay Lohan ever was an actress, this would still be one of her stupidest career moves, serving to bring into further disrepute a court already legendary for the smug arbitrariness of its judgments.

I thought all DUIs after 7/1 in LA County require an ignition interloc device? Where is this in the order or does she not have a DL?
Also, multiple DUIs can result in a year+ in jail. Read the law. She'll do some time, probably in a pay-per-night jail (not twin towers), but 10 days or less, or not at all (home arrest has already been hinted at).
It seems like a lot of people posting get joy from reading this sad story. I care about the facts, not what pleasure it brings to the hungry, general public.
Bottom line, big press posts this news to keep all of you sheep happy, not worrying about $10 a gallon gas by 2013, and the overall die off of humanity that will occur around 2020 (if you happen to live that long). That's why I don't believe in 401ks, suckers!

I mean after all the things she violated, she deserves going to jail, so she can learn to obey what the judge says.

nb2010 is wrong. I j ust saw the judge give the sentence: 90 day in jail, followed by 90 days in rehab.

all this was caused by fame

While the Judge is at it, how about sentencing both her ignorant and worthless parents to serious jail time. Michael and Dina are both pathetic publicity whores
and serial enablers of their children. I hope that despite jail overcrowding this little dimwit spends all 90-days, and then another 90-days inside a locked rehab facility. No Dr. Drew show, no Promises and no celebutard holistic rehab center.

She's young, talented and responsive to many of the same sensations that stimulate all of us.
Unfortunately some sensations have led to her abusing alcohol and drugs.
Lindsay isn't criminal and mostly dangerous to herself except when she drives under the influence.
I'm concerned about her overreacting to the sentencing and doing the ultimate foolish thing ending her talent and future. She needs to get off the drugs and clear her mind.

Does the SCRAM device actually work?

This is terrible. I just bought an App for my iPhone that let's me know when she's driving on the sidewalk. Now I have to wait 90 days to see if it works.

Another spoiled Hollywood brat bites the dust. It's not likely she will grow up though. Once a spoiled brat always a spoiled brat. They just get meaner is all.

Hopefully this is a bit of a wake up call for Lohan. After all, she was a great actress at one point in time and likely still is.

The tragedy of substance abuse are such that the courts are probably the worst place to deal with them, but where else do you go?
Fortunately she has a Dad and ex who is caring for her children.
She either takes the cure of dies, I've buried too many friends.

Another example of preferrential treatment (AKA corruption) for celebrities. What kind of example are we setting for our youth and for other law abiding citizens? Treat her like any other common criminal. That's what she is, right? Without money & fame, she would not have been allowed to "turn herself in" on July 20th. Incarceration would have been imposed immediatley. America is just as corrupt as the rest of the world. The judge in this case is no exception.
OJ, Charlie Sheen, Martha Stewart, Lohan, Hilton, Mel Gibson, shame on the Los Angeles County Criminal Court System.

Yet another joke sentence to prove celebs are above rank and file American citizens, 90 days in a celeb rehab while people truly addicted to substances are imprisoned.

Little Miss Britches thought she was "...doing what she was supposed to do." Well, she wasn't. My question is, where was her shylock lawyer all this time? With legal representation like this Little Miss Brtiches is lucky to be only going to a residential treatment program for a few weeks...
