Ex-soccer coach guilty of having sex with girl on team
A former coach for the Mission Viejo Soccer Club was convicted today of having sex with a 16-year-old girl on his team.
David Christopher Hernandez, 28, of Corona pleaded guilty to two felony counts of unlawful sexual intercourse with a minor, according to the Orange County district attorney's office.
Hernandez was sentenced to 150 days in jail and three years of formal probation. As part of his probation, he cannot work with minors or frequent schools, parks or any place where minors congregate.
In two instances earlier this year, Hernandez had intercourse with the victim in his car and at her home while her parents were away, prosecutors said. The parents found out and alerted authorities.

It's not rape. It's creepy, inappropriate sexual contact with someone WAY too young.

Otis, the word rape is nowhere in the article. 16 is the age of consent in some states; clearly not as much of a "big deal" as say a 12 year old.

Before you vote for judges make sure you check their sentence records. This is unacceptable, statuatory rape nontheless. If it were my daughter, oh my-would I be kicking and screaming-you betcha! Shame on this judge! I hope this family SUES as that will be their only justice.

Sex with a minor, though wrong and against the law, is hardly rape...

WOW, I heard she was not on his team, is this accurate reporting??? Also, does he have to register as a sex offender???

Yeah, no big deal in Cal at least. Try that in a state that cares about its people and the sentence goes into the years.

The girl wasn't on the team that he coach but, she was a member of the soccer club. It was a consensual relationship even though the government says it was illegal. Maybe we should lower the age of consent to 16. This wouldn't help Hernandez the 28 yr old soccer coach who was with a 15 yr old but, it would reduce over crowding of the courts and jails.

As you can all tell this was consensual sex. She brought the man to her house. The sentence was appropriate he was wrong for doing what he did but you can’t rape the willing. How can her parents not know that this was going on?

This is all racially motivated because it was a hispanic coach. In San Diego, a white British coach had have sex with minors and come to an agreement with the judge and when on with his "business" Justice in this country is for those without the "preferable" skin color and less resources and this news article confirms that.

Sorry to burst your bubble "Colnet" but this is most likely due to different policies between the different District Attorney offices. Different offices have markedly different policies for the same crimes.

This happens all the time and parents should be very alert to the relationship a male coach has with his female players. I played soccer and was a coach during my teen years. Many of the male soccer coaches are young (in their 20's and 30's) and so very attractive to these young girls because of the common interest in sports and the amount of support/commitment/encouragement they receive from their coach. It's very alluring, very attractive, and since you're spending hours and hours with your coach with practices and games, it's very, very easy for a relationship or sexual act to occur.
There wasn't one soccer team I was a part of (both AYSO and High School) that a relationship (or something) didn't occur between a coach and a player.
Rape doesn't always occur with violence. And the reason for statutory rape is to protect young, very easily manipulated girls from older men who know better (or should know better) and yet take advantage anyway.
Parents need to step up big time. It's a very wide spread problem in all sports, all club teams, all high schools, all socio-economic/cultural communities. Hope this was helpful.

So you people think that if an 8 year old consents to having sex, that's not rape...They used to call it statutory rape, but they changed the name to unlawful sex...same thing...
No wonder there are so many sexy deviants out there victimizing children...

Sex with a minor is not rape?! Puhleeze. It's called statutory rape because even if the underage victim is willing, she is not emotionally and psychologically ready to give her consent. So even if she does allow the physical act, her consent is no good. Hello? why don't we just let minors vote, drink alcohol, and anything else legislated for adults since they can make their own decisions for their own good. A 28 yr old, in a position of authority, can twist the girl to his own sexual needs. Although maybe if he did it with a 13 yr old and had some $$, he would do no jail time.
Yes, an adult having sex with a minor is rape.
