Phil Spector guilty in Lana Clarkson's death
Latest story: Phil Spector convicted of second-degree murder
Phil Spector has been convicted of second-degree murder in the fatal shooting of actress Lana Clarkson six years ago. An L.A. Superior Court jury reached its decision against the legendary music producer after nine days of deliberations. An earlier jury deadlocked 10-2 in favor of guilt.
The decision means the 69-year-old Spector, famed for his work with musical acts such as Tina Turner, the Beatles and the Righteous Brothers, faces at least 18 years in prison when he is sentenced. The jury determined that Spector killed Lana Clarkson, a statuesque blond actress, on Feb. 3, 2003, just hours after they met in the Sunset Strip club where she worked as a hostess.
Over the course of the trial, which began in October, the prosecution portrayed Spector as a sadistic misogynist who had a three-decade “history of playing Russian roulette with the lives of women” when he was drunk. A prosecutor told jurors in her summation that “by the grace of God, five other women got the empty chamber and lived to tell. Lana just happened to be the sixth woman who got the bullet.”
Spector’s defense contended Clarkson died by her own hand. They said she was depressed over her flagging career and the accompanying financial worries, and may have committed suicide impulsively after hours of late-night drinking with Spector.
Spector arrived in court Monday wearing a "Barack Obama" button.

I'm glad the jury got this one right, but it is astonishing that it took so long. This should have been an open and shut three day trial. I wonder how the two morons who held out at the first trial feel. Because of them Spector got to be free for a couple of years more than he deserved and the taxpayers are on the hook for millions.

He didn't just do it with women, he did it with men also. I believe was Phil Ramone who wrote in a book about being in recording session with Spector. He said Spector made them play the same song hundreds of times and when they wanted to leave the studio, he pulled out guns to prevent their exit.

We have a whacked judicial system, the evidence suggests to me he was more than likely guilty of manslaughter. There is no one on the face of this planet who can prove he possessed the intent with malice a forethought during the unlawful taking Ms. Clarkson's life to constitute a murder verdict.

Remanded to custody too!
That is key so this [expletive] can't just shoot himself and take the easy way out while awaiting sentencing.
Rot in jail, Murderer.
Rest in peace, Lana.

I guess this means that if I ever get rich I will have to use a bit of discretion if I ever intend to murder people. The good old days of just poking guns into Amazon women's mouths have apparently passed us by...

Rest in peace, Lana.

For those who think 2nd degree murder wasn't warranted, here's the definition::
"Murder of the second degree is similar to murder of the first degree, except the element of premeditation does not have to be proven. All that is required is subjective awareness on the part of the defendant that his conduct is dangerous to human life. Second degree murder is such a killing without premeditation, as in the heat of passion or in a sudden quarrel or fight.
Malice in second degree murder may be implied from a death due to the reckless lack of concern for the life of others (such as firing a gun into a crowd or bashing someone with any deadly weapon). Under California law, the penalty for second-degree murder is life imprisonment without the possibility of parole."

Thank Goodness!!!!!! My faith in the judical system is restored. Phil Spector will sleep behind bars tonight, long overdue. Isn't it sick that he and the bimbo have stayed this whole time under the very roof where he killed Lana? That's creepy. Shelly will have to find a new sugar daddy since Lana's Mom will own the house before long. I hope this brings a small bit of peace to Lana's family, who have suffered too long. Rest In Peace Lana, and thank you jury, you got it right.

From WipiP:
Stories of Phil Spector's gunplay mounted over the years, including his discharging a firearm while in the studio with John Lennon during the recording of his cover album Rock 'n' Roll, either placing a loaded pistol at Leonard Cohen's head or threatening him with a crossbow during the sessions for Death of a Ladies' Man, and forcing Dee Dee Ramone to play bass guitar to Spector's specifications at gunpoint. Cohen told Rolling Stone magazine in 1978 that, "Phil couldn't resist annihilating me. I don't think he can tolerate any other shadows in his darkness."
Gawd only knows how many other people Spector threatened at gunpoint. This verdict is long past due.

Ho hum, killer alcohol strikes again, so common it's hardly news. Kindly remind me again why this agent of death is legal but far, far less deadly cannabis is criminal. Is this some kind of a joke? Or a deliberate attempt to weaken and divide the country? Whatever it is, it needs to be sent to the garbage can of history.

Someone previously mentioned defending the second degree murder sentece: "All that is required is subjective awareness on the part of the defendant that his conduct is dangerous to human life." Oh, so playing Russian roulette is not dangerous to human life?

So who gets the dough from the royalties of his productions? This is not the same as the Simpson-Goldman civil case. There are no kids or previous life (prior to that night that he met Ms. Clarkson) that can be established. In the case of Goldman, he got the judgement mainly because of the Nicole Brown and the childrens relationship and not because Ron Goldman was a "B" actor. In fact, he was not even an actor, just a waitor in the wrong place at the wrong time (as I recall). That would mean that the Clarkson's might win a judgement in a civil trial, but the 'new wife' of Spector would still get the assets, as there is a live wifte (not like the Simpson case) and the judgement would be less than the Goldman judgement. It will be interesting to see how the civil side unfolds. In the meantime, Spector won't last 5 years incarcarated. He might not even survive detox the first 30 days until sentencing!!! He was stoned through the '90 and the 00's!!!

Spector was guilty, no doubt about it, and getting a hung jury last go around bought him a couple of more years... but retrials are usually a long shot for the guilty defendant... they just postpone the day of reckoning... I reckon. Phil is a nice guy, and I'm sure that doing what he did, and being who he is, he'll be meeting lots of really kind gentle people on the inside, who are going to treat him right, and give him the recognition he deserves.
Posted by: Fido | April 13, 2009 at 04:54 PM
Can't wait until the appeal. The bimbo was sitting in a chair and was shot in the roof of her mouth. exactly how does that happen? Clearly a suicide. This verdict will not stand. Phil is da man!

Today, my faith in LA juries has been revived. I am thrilled that these 12 people used common sense in vetting the facts, spitting out the hyperbolic defense claims of Lana's state of mind. The defense tried to murder her memory, along with the ashes of what was left of her after a demonic psychopath pulled a gun on her and shoved it in her mouth, discharging it.
THANKS TO THE JURY!!!! I've waited SIX years for this day!
Posted by: Michele | April 13, 2009 at 04:59 PM
One last thing: that old saying "you can't tell a book by its cover" is proved wrong by the pic at the beginning of the comments section here. Spector is a stone hearted, cold blooded psycho. He's a moron, and I don't really think he intended to kill Clarkson, but that was bound to happen, with all the times he's done that kind of thing. I remember a story of him pulling a gun on John Lennon 35 years ago... to the person that said that people never commit suicide in front of others - that's not true. My uncle shot himself in front of my aunt over what color carpet to put in their den. But in THIS case Spector pulled the trigger NO DOUBT.

It's so nice that finally money didn't buy the freedom of yet another spoiled superstar. And that a jury in LA could finally look past celebrity and high priced lawyers and put a murderer behind bars. Big Props to the jury and Mr. Jackson, a job well done.

Enjoy the total change in your life, Phillip, as long as you can stand it.

THANK YOU JURY!
At long last there is finally justice for Lana and her family.
Spector managed to live his life as an alive free man for 6+ years, but he will now spend the rest of his life in jail. Not a great future for someone that appears so debilitated.
My husband an I watched the first trial and will never understand the thinking of the two men that hung the first trial. It seemed so clear cut, once you got to the states case and beyond the garbage that was thrown about by the defense. They threw the spaghetti against the wall and unfortunately a tiny bit of it stuck. NOT THIS TIME, the garbage stayed in the garbage can.

PS is a sick creep and murderer and is getting what he has long deserved-i am only sorry what seemed to be a good and kind woman had to die to put him away--and SHAME on the defense team in trashing her to try and protect their clearly guilty/psycho client...guess money cant make intelleigent people buy complete BS, can it?

FINALLY! If anyone followed the first trial, it was total jerk who lived in his neighborhood who was the idiotic holdout, the other no vote was just someone who was a follower, not a leader. This time, they got 12 COMMON SENSE people who looked at the behavior, the human nature and the evidence and realized that whether he intended to kill her or not (first degee), he acted with reckless disregard and took an innocent woman's life.
Have fun in the Big House, Phil. I'm sure you're create your own wall of sound eventually!

I noticed in the photo gallery a very immature description of the photo of Spector standing with Sheryl Crow which read, "Spector is the one with the curly hair." Reads more like a high school yearbook, not a major newspaper.
That was a particlarly thoughtless comment. Real life, horrible murders are not funny. You'd have to be detached from life to laugh at jokes about "longhairs" being indistinguishable from women in 2009...or any year.
I hate the madness of that as much as I hate what Spector became.
Posted by: Richard Ray Harris | April 13, 2009 at 08:29 PM
I watched as much of the first trial as Court TV carried and I am convinced that he should have been convicted at that trial. At least this jury got it right. I doubt seriously if Phil Spector will survive that many years in prison, but then that is his problem.
Posted by: Caroline Jenkins | April 13, 2009 at 08:37 PM
During Spector's first trial on Howard Stern's radio show Joan Rivers (JR) recounts a party she had in New York before Lana's death. At that time her personal assistant, Dorothy, was dating PS.. JR says PS was at her party and starts waving his gun. She had to have her security escort him out of the party. PS should have been stopped long ago. But no one pressed charges (typical Hollywood) and years later Lana Clarkson pays the price. I would suggest someone make a movie about this tragedy. Silly me: It happens repeatedly in Hollywood. Who wants to pay for another B movie with a predictable ending.
Posted by: yvonne | April 13, 2009 at 08:51 PM
Bob Shapiro will take any case. Does he feel any guilt knowing Spector killed Lana? Or Dr. Lee destroying evidence? Does all of the people he welded guns on feel any remorse that they didn't file charges? Many had enough money to win a charge against Spector. Numerous people had to know Spector was a cruel, sick man. But only one person we know had to sacrifice her life to finally lock up this demon. Betcha his current wife is sleeping peacefully tonight with him in jail!

Phil Spector looks like a specter, i wonder what kind of women fall from him. There's something already sinister with the way the man looks, the only thing that might have been attractive with this man is money.
its just right that he'll be in prison for the rest of his remaining but i just wish women will not let themselves fall victims to men who are obviously on the lookout for a next victim.
Posted by: dentalconsultant | April 13, 2009 at 09:16 PM
There are two sons from his first marriage, but Phil couldn't care less about them. He has never helped them and they have medical and financial needs. I have read that he has huge legal bills and that he owes money around town from his first trial. He won't have the funds to win an appeal,IMO...Rachel deserves all the $$$ she will get living with him.
Justice delayed was not justice denied!! Rest in peace Lana!!!!!
JUSTICE HAS BEEN SERVED, PS WILL DIE IN PRISON.. You can fool some of the people some of the time, but you can't fool all of the people all of the time:)))) A wise jury served this country with my respect!!

It's strange that law authorities got hold of a mentally deranged person like Spector after he committed homicide of heinous nature, killing an artist;while he had already made lethal attempts on the lives of five other women.
It calls for strengthening legal system and allied services to ensure no criminal can stay free so long by using his riches.

To all those who put any stock in the BS defense theories... think this through... Lana Clarkson goes home with Phil Spector and decides to kill herself??? She just decides on the spur of the moment that she doesn't want to live? Okay, watching some drunk slobbering old fart in his living room, I can see how she'd conclude.. "This is how far I've sunk"... but how does she then get his loaded gun to blow her own head off??? And then he goes out and tells his limo driver, "I killed her"??? Or he just didn't give the limo driver a big enough tip, so the limo driver thought he would put Phil in jail for life as payback? How can anyone believe a word the defense said in the first place????

I commend this jury, finally a group with common sense who were not swayed by his celebrity status or money. Being from the Midwest I have often wondered about juries in California especially after OJ Simpson and Robert Blake and, the last Spector trial with the idiot who would not have found him quilty if he had been present at the scene or had a video of the murder. Thank you jurors for doing your job of looking at the evidence and rendering an impartial verdict.

good that spector was not released on bail till sentencing.

At last. Spector's attorney said that he didn't believe there was evidence to prove beyond a reasonable doubt Spector killed her. I know an attorney needs to say something but, PLEASE. Spector would have been found guilty in his last trial had it not been for the arrogant ass who thought he was so much more intelligent than the rest of the jury and wanted his 10 minutes of fame. Even with all the attorneys he had last time and experts he would have been found quilty. Kudos to the judge also. Spector is a danger and a flight risk and should have been taken into custody.

The sentence for 2nd Degree Murder is 15 to life. The enhancement for use of a gun is an additional 25 years to life. That is 40 to life. He will not be eligible for parole for very nearly 40 years. But it really doesn't matter since about 1% of lifers get out, the rest die in prison.

the witch hunt is over they got mr. spector. if mr.spector truly committed this crime then i'll be the first to say that i was wrong and anyone who willingly and knowingly takes the life of another deserves to be in prison. even if mr. spector is guilty he did not get a fair trial. i do believe that he had a bias judge and that to make sure things were fair there should've been another judge for the retrial. i know that 30 year old evidence should not been allowed in the courtroom. it was irrealavent! the only thing that matters was who pulled the trigger! i don't think that mr. spector could get a fair trial in los angels. good luck to those who think they'll cash in on phil's fortune and the castle. there are loans against his royalities and the castle and other property that he owns. six years of attorney's fees roughly about $8-$10 million anyone rich or not would feel that kind of pull on your wallet. lana clarkson did not deserve to die like that, know one does. my heart has always felt the pain i saw on ms. donna clarkson's face. i for one am sickened by the whole ordeal the clarksons have loss there loved one and a emotionally distrubed man who should've been hospitalized a long time ago also loses his life.

Where were the brains of the 2 jurors in the 2007 trial who caused a hung jury? The law says "beyond a reasonable doubt." Lana's shooting herself or questions about the chauffer's misunderstanding Spector's own statement that he thought he had killed someone could not be considered reasonable doubts -- if these jurors themselves were reasonable persons. Lana is already at rest. I will pray that Spector will somehow discover empathy and what it means to be human.

Cheers to the jury and Mr. Jackson!! Justice at Last for Ms. Clarkson and her family. When the state is the only voice for the victim, Ms. Clarkson Cried out for justice and was at last heard loud and clear. Spector should have been dealt with years ago. If his star status hadn't gotten him out of trouble in the past this mad man would never have been in the postion to take the life of such a beautiful person as Ms. Clarkson. It is finished. May she rest in peace.

Many thanks to the jury for getting it right this time....
You have provided an enormous service to the state of California.

I'm very happy that the jury decided on a verdict. I'm very angry that justice takes WAY TOO long to get a trial started and finished. Mostly I'm just waiting for when some appeals court overturns the verdict. Though I'm glad he was found guilty, and I haven't had any run-ins with the law, I hate our legal system; you just KNOW this is going to get reversed and it's absolutely MADDENING. Our legal system sux.

Phil DID NOT GET A FAIR TRIAL. The judge was incredibly biased, and made rulings that will be overturned on appeal. The jury convicted him because "they didn't want to fight each other?".
That tells me there were no independent thinkers on this jury.
The judge didn't allow in evidence that Lana had threatened before to kill herself. Or that she had worked as a prostitute.
How about that the chauffer-DeSouza-was in the country illegaly in 2003, and the DA had him stay and got him legal status. And his english was very poor. In portuguese, they "speak backwards".
Phil was convicted because of the past acts from 30 years ago. He was charged with none of those incidences. THERE WAS NO EVIDENCE THAT HE PULLED THE TRIGGER. Lynn Harold, the DA's chief criminolgist, could not place the gun in his hands. Reasonable doubt? Hell yes!

Let's see now. By my count, since the verdict Whineberg has blamed his loss on the judge; the prosecutor and the jury.
I would say he's still in the denial stage. Can't accept his defeat and still trying to rationalize it. Why can't he just admit that his client was guilty and that the evidence was all there?
Both Whineberg and his client seem like narcissistic egomaniacs.

I can't believe some people on here are defending this sleazeball. He may have been a great producer but as a human being he gets an F. The evidence combined with his past history of obsession with guns and women was overwhelming. Justice will be served in this case finally. Phil has a really dark side for sure.

I watched every moment of the first trial; Allen Jackson was amazing... regretfully a few dim juriors were on board. Happy to see that the retrial rendered a different result. Spector is lower than a pregnant ant... Lana Clarkson needs to be remembered as a human being that was in the wrong palace at the wrong time. Bad things hapen to good people. Here's to Spector being some thugs prison bitch... pick up the soap Phil and get used to the new "wall of Sound"

I watched the verdict being read, and watched Mr. Spector hold his composure. The verdict was wrong, an innocent man has been sent to prison.
I hope that the judge, jury and Alan Jackson have a hard time sleeping at night.
He still has his appeals, ever how long they may take.
I am still on his side, always will be.

I am glad the people put this self centered low life ,thinks he can buy out with money and power He is lucky she wasn't my daughter! i hope he lives in prison and gets no better treatment! I also hope her family get all his money and his wife gets the rest!

The verdict was correct and frankly I am sorry it took 2 trials to get here. I cannot believe how many people still support Spector especially considering the guys habit of pulling guns on women (thats not normal folks!.) Spector is where he belongs and I hope he is there forever.

I was devastated by the first trial. I watched every day and could not believe those jurors! Thank goodness they made the right decision this time around, it is a shame that it took so long for Lana Clarkson to rest in peace. God Bless you Clarkson family, and don't worry the normal people of the world know that he killed your beautiful Lana.

How would folk feel if I were to say that Lana Clarkson got what she deserved for giving us "Barbarian Queen," the worst movie in history and the only movie that sucks away intelligence out of the viewer? Most would say that I am being hateful. Well, almost everyone posting here are hateful. It is as though you all have a personal vendetta against a guy you don't know regarding a situation that you are clueless about. What occurred was a tragedy for Lana Clarkson, Phil Spector and their families. For those posting here, this was a news story only and their behavior is simply that of angry ghouls staring at a train accident. Someday, their mean-spiritedness will come back to haunt them
