Man jailed in hit-and-run in San Diego County

January 5, 2009 |  9:01 am

Sudac_4 A 27-year-old Carlsbad man is in jail in connection with a hit-and-run crash on Interstate 5 in San Diego County that killed a pregnant 24-year-old woman from Tijuana.

John F. Sudac voluntarily surrendered Sunday night, officials said today. He is the registered owner of a vehicle that collided near Solana Beach on Sunday morning with a car in which Yina Gonzalez, her husband, 5-year-old daughter and two other relatives were riding. Gonzalez was six months pregnant; her fetus was also killed, officials said.

Sudac allegedly stopped at the scene of the crash and then left. He faces possible charges of felony hit-and-run, gross vehicular manslaughter, marijuana possession and drunk driving, the CHP said. Officials also are seeking a person who stopped at the crash, grabbed Gonzalez’s purse and drove off.

Hmm, Methinks there are a few charges too many in this report. If he left the scene, how then do you charge or even convict him of drunk driving when the accident accured? Felony hit and run, the story say he alledgely stopped at the scene, then left. So felony hit and run should not have been a charge. No one is sure why he left, it could have been to call for help for the injured as it doen't mention that he had a cell phone. Later getting scared then deciding not to return. Prosecutors always seem to charge citizens with as many charges as they can think of in hopes of getting a conviction on something, instead of actually chargeing a citizen with just the crime they commited.

Au contraire, Robert -- throw the book at him!

Umm when you hit someone and leave the accident before the police get there and then fail to return that is the definition of a hit and run! He could be charged with drunk driving based on witness testimony. If they found drugs in his car after the fact they could still legally stick that charge on too. I find it interesting that the illiterate are always the ones that try to defend the criminally negligent. This guy actually got off easy. In New York the charge would be murder two based on depraved indifference, with a sentence of 15 to life. I don't see the point in defending someone's actions who killed a woman, her unborn child, then fled the scene. Even if he wasn't drunk that is vehicular manslaughter! But no you're right I'm sure he was really using the phone at his house to call the cops. Don't be so stupid!
