Halle Berry can take Nahla to NYC to shoot ‘New Year’s Eve’

Halle Berry is back in ‘New Year’s Eve,’ the star-studded Gary Marshall film she dropped out of to prepare for her custody battle with ex-boyfriend Gabriel Aubry, whom she split from last April.

A Los Angeles judge ruled in Berry’s favor Wednesday, allowing her to travel with their 2-year-old daughter, Nahla, so she could continue shooting the ‘Valentine’s Day’-style film. The Oscar-winning actress had been warring with her ex-beau for custody of the child since December, and it was getting ugly.

Since the court ruling, Aubry withdrew his custody petition to be formally recognized as Nahla’s father and share physical and legal custody of the child,but he plans to file a paternity action, TMZ reported. He was also spotted Thursday at the L.A. Zoo sharing a moment with his daughter.

Berry, who will now play a nurse in ‘New Year’s Eve,’ had given up a larger role in the film to Katherine Heigl last month amid her legal woes.

She’ll be returning to New York with Nahla in tow to shoot the film co-starring Sarah Jessica Parker, Jessica Biel, Seth Meyers, Zac Efron, Hilary Swank, Ashton Kutcher, Lea Michele and Robert De Niro.
