Fantasia Barrino, the third ‘American Idol,’ has been accused of having an affair with a married man, CNN reported, with recordings made of their, ahem, ‘activity’ -- and of doing it in a state where a tape of that kind of ‘activity’ could come back to bite her in a court of law.

In a North Carolina divorce filing, Paula Cook alleges that the singer took up with her husband, Antwuan Cook, after the two met in August 2009 at the cellphone store where he worked. According to the documents, Fantasia took Antwuan to Atlanta, Miami, New York, L.A. and Barbados over the course of the alleged affair.

[Updated at 2:06 p.m.: Barrino is ‘certain that she is not responsible’ for the failure of the Cooks’ marriage, her manager said in a statement. He said, in part, that ‘Fantasia will weather this storm with the dignity and grace that she has exemplified,’ TMZ reported.]

North Carolina’s not a great state for this sort of thing either. Adultery there is a still a crime -- for real. ‘You can sue that third party,’ says a law expert quoted by Bossip. ‘Most of the cases involve sex, it doesn’t have to be sex, it can be something much lower.’

Rumors of an affair were floating around gossip circles in November 2009; according to TMZ, Barrino has denied it all. Divorce papers were filed Wednesday.

So, is it ever worth the risk to make a sex tape? Let us know in the nonscientific poll after the jump -- and feel free to explain, tastefully, in comments.
