I agree that Allen was snubbed, but not entirely for the reason you say: Her problem was that Amy Winehouse & Feist were ploughing the same ground. I agree that her release date early in the award year worked against her.
As far as the "release date" rule, you've got to cut things off ahead of time, and you can't possibly expect the Academy to let P2P define release dates. (Though MySpace is perhaps an issue, download sites like iTunes follow the release date rules.)
The problem is that many people--even music critics--don't understand the Grammys use an awards year of 10/1 to 9/30, not the calendar year like the Oscars. (The Emmys & Tonys don't use the calendar year either, but they're geared to the usual seasons of TV & Broadway; movies & music don't have that.) Most Oscar watchers seem to know the rules, but most Grammy watchers don't.
