10 more GOP senators demand answers from the NEA about teleconference

Ten Republican senators have written to National Endowment for the Arts chairman Rocco Landesman, expressing concern that the Obama administration may have violated federal law by trying to use the agency for political purposes -- something the White House and NEA have denied.

The charges stem from an Aug. 10 teleconference in which the NEA's communications director urged members of the arts community to help Obama's efforts to spur volunteer community service.

Yosi Sergant was subsequently demoted by Landesman, and resigned Thursday. It was accepted effective immediately, an NEA spokeswoman said, adding that Sergant left voluntarily because he thought "he felt he was becoming a distraction for the agency."

Sergant, a former Los Angeles publicist, supported Obama's presidential bid and worked closely with artist Shepard Fairey on his independent "Obama Hope" poster campaign.

At the White House, the special counsel's offfice issued a memo to "White House staff and...agency and department heads," urging all hands to avoid "even the appearance of politicization" during "public outreach efforts" like the teleconference. The White House previously had issued a statement of regret about the incident.

Patrick Courrielche, a former employee of Sergant's with his own Los Angeles marketing company, was part of the group phone call and later posted a recording and transcript.  Writing on the Big Hollywood blog, Courrielche said the teleconference was improper political organizing on behalf of the president's legislative agenda. Courrielche also shared his concerns, and parts of the recording, on Glenn Beck's Fox News program.

Questions from elected officials about whether the NEA was being politicized followed. First, Sen. John Cornyn (R-Texas) sent an open letter to the president, raising concerns that the NEA had become subject to "political manipulation by the White House," and proposing congressional hearings.

He has now has been joined by all ten GOP members of the Senate Committee on Health, Education, Labor and Pensions. On Wednesday they signed the letter to Landesman, the NEA chairman, calling for a more detailed explanation of the teleconference. They also want assurances that it did not violate laws prohibiting federal agencies from spending tax dollars for political causes, and that ban employees from engaging in partisan politics while on the job. Signing were Republican senators Mike Enzi (right) of Wyoming, the committee's ranking GOP member, Lamar Alexander of Tennessee, Richard Burr of North Carolina, Tom Coburn of Oklahoma, Judd Gregg of New Hampshire, Orrin Hatch of Utah, Johnny Isakson of Georgia, John McCain of Arizona, Lisa Murkowski of Alaska and Pat Roberts of Kansas.

They said that while they "appreciate" the statement that the NEA head issued this week on the controversy, they want more information. They requested that Landesman respond no later than Oct. 1

In the House, Rep. John Kline (R-Minnesota) called for a hearing on the matter by the Education and Labor committee. The committee's chairman, California Democrat George Miller, said he would give it "due consideration."

In his statement this week, Landesman said there was no political agenda or discussion of legislation on the teleconference, but that Sergant was demoted for crossing a line by urging artists to use their talents to support the government's volunteerism efforts, rather than simply sharing information on the volunteerism opportunities that are available through United We Serve .

The ten senators wrote that it is "problematic" that Landesman's statement didn't rule out the NEA continuing to spread the word about the volunteerism initiatives, and it also objected to a link on the NEA's website, since removed, to the Artists Healthcare Insurance Resource Center (AHIRC), which is sponsoring a write-in campaign urging Congress to pass "a real health care reform bill."

An NEA spokeswoman, Victoria Hutter, said Thursday that the link had been posted since the late 1990s because the endowment supported the Actors Fund charity for ill performers, which is affiliated with the AHIRC. But in the wake of the current controversy, she said, the endowment has realized "the need for an immediate and regular audit of its web site." The AHIRC link was removed to avoid "the appearance that the NEA is endorsing its lobbying activities."

The NEA's main role is sifting through nonprofit arts organizations' applications and deciding how about $133 million in annual grants should be disbursed,

In the transcript posted by Courrielche, the three government participants, Sergant, Nell Abernathy, director of outreach for United We Serve, and Buffy Wicks, deputy director of the White House Office of Public Engagement, assume their audience is pro-Obama; there is a blurring in their rhetoric between the goals of the election campaign and the goals of the volunteer programs they are promoting.

Wicks starts her presentation by noting that she was Obama's campaign field director in California and thanks her listeners "for all the work that you all put into the campaign for the two-plus years that we all worked together....We won and that's exciting, and now we have to take all that energy and make it really meaningful."

Abernathy also alludes to the arts community's "powerful" contributions to Obama's election victory, noting how Fairey's Obama poster  "made...our mission instantly recognizable and relatable to people."

Sergant then asks the artists to get involved in promoting volunteer service in "four key areas" that another nonpartisan government agency, the Corporation for National and Community Service, has identified. In her talk, Wicks had listed them as health care, energy and the environment, education, and community renewal.

But when someone asks how artists can promote legislation such as health care reform and Obama's cap-and-trade pollution control proposal, Abernathy answers that it's not a proper subject for the teleconference. As a federal employee, she says, "we have to, for legal reasons, remain really separate" from partisan work, adding that at most she can refer the listener to the Democratic National Committee for further information.

As for Courrielche, he's taking some return fire in the blogosphere. In an article on the Huffington Post, writer Lisa Derrick suggested that he broke laws in various states against recording telephone conversations without the other parties' permission.

Under the California Penal Code, Section 632, it is a criminal violation, punishable by up to a year in prison and a $2,500 fine, to record a “confidential communication” over the telephone, “without the consent of all parties."

However, the state law has a broad exception: it is not illegal to record at "a public gathering or in any legislative, judicial, executive or administrative proceeding open to the public, or in any other circumstance in which the parties...may reasonably expect that the communication may be overheard or recorded."

On his blog, Courrielche issued a statement Thursday saying that since invitations to the teleconference went out nationally, including to some media outlets, and because it was organized by federal agencies, "there was no expectation of confidentiality or that the call would not be recorded."

White House spokesman William Burton said by email Thursday that "this is a state law enforcement question which we will have no comment on."

The GOP needs to focus on proving they are effective leaders, not trying to vilify everything their opposition does just to leave themselves as the only alternative. It's a dumb strategy and they look dumb executing it.

So what the hell is wrong with encouraging people to participate in community service? Jesus, Republicans are just a bunch of overweight white hacks who think it is okay to sit around, ignore the impoverished and get rich of insurance company kickbacks. I'm sick and tired of this crap.

What a bunch of hogwash! After the shenanigans of the Bush administration (roll tape of him "landing" an aircraft on a carrier then climbing out in his little jumpsuit like he'd really done something, scaring hell out of the entire populace of the planet, being a general dink of a human being, not caring whether or not employees get a fair shake, breaking our economy, being the world's biggest terrorist, etc.), the GOP really has some brassies using this in any form or fashion. The statement that tax dollars cannot be spent on political agendas and that fed employees are prohibited from "engaging in partisan politics while on the job" is ludicrous in light of some of the Bush tactics. Who does the GOP think arranged for Bush's procurement of church member rolls in the campaign year before the 04 theft of office? Get real, GOP, your losing it and you know it. Your tactics smack of fear stress... and serious future losses.

You've done a better job at reporting in this story than 90% of media outlets, who have been reporting the Glenn Beck accusations of propaganda uncritically. However, you should have gone farther to debunk the lies! For example, noting that there was no offer of money or other support, that most of the people on the call would never be eligible for NEA funding etc.

The amazing thing to me is that no one can control the news anymore. It just burps out on to the internet and the people choose what is important to them. More of our grandchildren's money spent (TRILLIONS -- MORE than all 43 previous Presidents totally ever borrowed / spent or made), borrowing money from our enemies so to speak (China and even my grandson ask, ' why do they want to loan us money because they do not even like us? Explanation and understood by the 10 year old as they make lots of money back on the thing called interest!.
We have been called a non-Christian Nation, omit the National Day of Prayer but we have the Muslim week end at the White House this week end. This is okay as we are entitled to the FREEDOM OF RELIGION in this nation but WE STILL were denied the national Day of Prayer in the White House by our President who worshiped for 20 years with a man who repeatedly yells out G__ __ D__ __ __ America!
We have a president who 'approves of abortion', approves of illegal aliens as he even has his Aunt who has been illegal alien for years, who is out there STILL campaigning and spending the tax payers money jetting around this country when he could leave his tele-prompters in DC and work from there.
We have an administration who does not 'read bills' and vote for how ever Madam Polosi and Harry Reid & their party demands. Reading some of these bills takes one refrence after antoher to even 'attempt' to know what it says. We see pork abundant in the stimulus bill of which only a small amount has even been 'paid out yet'.
CASH for CLUNKERS people sure bought them but the COST exceeded the good as to what it was costing to also RID of the 'clunkers'. In Florida they were turning around and selling the 'clunkers' because they were not getting their money from the good old boys in the Government agencies. Will there be statistics of car loans taken out and being re-possessed because those buying them should really not have been buying them. We learn priorities in life and far to many 'abuse' that option!
TURN ON THE WATER in California! When we see a 'fish' being saved rather than human beings having jobs and the food being grown we have to ask........ 'what is wrong with this picture'? There are alternatives for the fish & most love their pets and animals but please, this is insane what is happening in the Bakersfield area!
WHO would have thought this time last year that we as a country would be owning AUTO INDUSTRIES (have you received a bonus check for it yet? don't think so). Bail out this. Bail out that! Who is going to bail YOU out when you are in the food line?

If 'children in school were chanting songs about President Bush WHAT would have been the ramifications? These teachers or schools allowing this need fired! Movies being shown about the how 'bad capitalism is'..........

When we have our president bowing to leaders, speaking against this great nation with regularity it is evident that he has no respect or love of America.
He is seeking the POWER of not only this nation but the world. One of the greatest things is though, every time we hear him he is 'waking up more people' because the Patriotism and love of Liberty is greater than his words of 'him'!

Artists are free to create art to publicize a politician or a political party or a political agenda. But understand that it is NOT art. It is advertising. It is a commercial. It is even propaganda. But it is NOT art. (The Obama Hope poster is derivative and has appeal for people with no knowledge of art). The White House has co-opted the NEA to try to start a phony "grass roots" movement among artists. Artist need to learn the difference between art and politics. And why the two have different aims.

Dear "Woke up,"

I am very happy that you have begun to pay attention to the news and to public affairs. Being awakened to the world around you is a valuable thing. However, it's also important to make sure that the sources of your information are valid and trustworthy. You also need to understand that a country this size can't go down the toilet in 9 months. That really is applying messianic qualities to this president that he doesn't merit.

Instead of only looking at the last 9 months, I strongly recommend that you look closely at the last 300 years. It's an amazing path this country has gone down. Sometimes it seems awful to me, how did we survive the calamitous change that happened along the way, like the Civil War? The truth is that democracies go through political ebbs and flows and our Constitution has survived. Often, during times of intense change, segments of the population "wake up" and decide that America is going to hell in a hand basket. The problem is they look through the lens of one microscopic slice of history (say, 9 months) and then draw conclusions from that itty-bitty view. It's like looking at one-inch section of skin from an elephant and deciding what the thing is. You're missing the larger picture.

Now, this article is about the arts. It's about whether or not federal employees "appeared" to be politicizing a federal program. With a grasp of history, you would understand that one of the favorite Republican charges is "politicization," especially about the arts. Democrats used the charge also during the last administration when it was proved that federal prosecutors were fired because they didn't support the Republican administration's political agenda, when they wouldn't prosecute Democrats for voter fraud during an election year. In this case, those rotten Democrats are "violating the law" by promoting volunteer service to the poor and elderly.

So, thank you so much for waking up. It would give you much, much more credibility as a critic of the American political landscape if you had even the smallest grasp of American history, much less human history. You'd understand that you're being very myopic. Truthfully, you appear reactionary. That's scary to me because my studies of human history tell me that when reactionaries get as angry as you seem to be, then terrible things happen. Recent events in Kentucky scare me to my core. So, yes, please express your opinion loudly to the stars, but know that if your information is wrong, then you will look like a crazy person instead of a legitimate critic of government.

Oh, and, I recommend that you review the different uses of the apostrophe. It is a true sign of ignorance (which means uninformed, not stupid) when they are confused. Do not use an apostrophe to make something plural. That has never been correct.

Good luck with your education. We welcome you to the community of people who make the effort to examine their lives and their world, as artists have done for thousands of years. Widen your lens, though, and see the rest of the picture. Then, come to a conclusion. Conclusions are powerful things, you know. Look at all sides, test the information you learn, think about it for a little bit and then come to a conclusion. It's much safer for all of us when you do that.

Van Jones...Yosi Sergant both claim that they resigned from their positions because they have become distractions only to deny accountability for their absolute immoral and radical behavior. Today White House officials are meeting with the chiefs of staff of the executive branch agencies to discuss rules and best practices in this area, a conversation during which they will be told that that while White House lawyers do not believe that the NEA call violated the law, "the appearance issues troubled some participants," Burton said. "It is the policy of the administration that grant decisions should be on the merits and that government officials should avoid even creating the incorrect appearance that politics has anything to do with these decisions."

This was totally political and anyone who has bothered to listen to the tape sees the parallel in the videos of kids being forced to sing some sick fascist hymnn praises Obama's "many accomplishments". We are talking about kids in kindergarden on up.

As an independent sick of both parties bs, I find what is going on in this administration much more alarming and damaging long term that Bush's follies. We are going to be looking at Carter era inflation within a couple of years and rapidly rising taxes to support interest payments on the debt service only.

Artist in Baltimore : I 'woke up' long ago and have studied / watched/ listened to / and determined nearly many years ago of 'who I was learning the TRUTH from and the FACTS of what was really going on in the United States.
Now it is enlightening to see others 'waking up' as we have seen 'all of which' I wrote occur and far more.
I referred that neither is perfect yet I will choose the FREEDOMS of my forefathers design far more than that of a dictatorship the leadership attempts by those in Washington at this time.
If you like listening to a president talk the United States of America down then perhaps you are sleeping on the set.
Many of us are agreeing, "let him talk because he is opening eyes with every read speech'!

I am the 'healthcare professional' who has taken care of the people from Canada and other countries who 'come to the USA for their timely care. Either paying the price or being 'snow birds' and pay for U.S. HEALTH INSURNCE because they want QUALITY-TIMELY health care and we offer the BEST health care in the World! I have also been in the homes of people who 'live off the land' when they have every ability to be doing something for themselves.
There are those who have needs and church's and groups do that with honesty!!!

Your refrence to 'ity bity view' ---- I have watched this man's actions and his associations for the number of years in Illinois. He has been a community organizer with the association of people I would not persnally set down to dinner with.
He lied about those associations and there is plenty of FACT-pictures and truth to be found if you choose to do so.

Says nothing about his representation of his taking oath into office to 'representing all people of the United states of America!
I am angry, but because I am not afraid to stand for something, rather than fall for anything as most of us who do not have 'blinders' on and are willing to lay in bed with all the corruption and the main line media and the failing going down the tubes news papers of the world.
It is because they are not HONEST or telling the FACTS and the TRUTH is why they have low viewer-ship and low readership!
